I think they knew exactly that this would happen. They had to follow the proper protocols for this stuff knowing full well this would happen. IT does a couple of things, it reveals just how corrupt local RAT government really is there, and now the FIB can be hounded to actually do something. And IF they don’t, perhaps U.S. Marshalls may take a keen interest in what’s happening.
DOD and Intel has a hold of these things. They are the lead on this. It really does not matter what the FBI does or doesn’t do. They are outranked and this due to the CCP/Iran involvement it’s out of their hands.

Rudy probably knew the Delaware police were going to do this (i.e., turn the evidence over to the FBI for safekeeping and ultimately destruction or “loss”). I mean, Biden is like the king of Delaware so who would believe that anyone in his own domain would prosecute him?
I have to assume that the US Marshalls was always the intended destination for any real investigation and/or legal action.
The FBI would have conducted midnight raids on every Don Jr residence and CNN would have been there filiming coincidentally.
Anybody in Delaware, if you are stopped by Delaware State Police, just say “My name is Hunter/Ashley Biden. You can’t question or arrest me”.
The FBI leadership in Delaware was probably hand-selected by Biden himself, ensuring loyalty.
