District Court Judge Emmet Sullivan has issued an ordering directing the Parties to take certain steps in the aftermath of yesterdays decision by the Circuit Court of Appeal to deny the Petition for Mandamus.
Here is the order:

As I noted in my story yesterday on the decision, at the very end of the opinion the Appeals Court directed Judge Sullivan to resolve the matter with dispatch which is a backhanded way of saying he had not acted in such fashion up to this point in time.
Judge Sullivan has entered an Order today which essentially ignores all the briefing that took place before the Appeals Court, and directs the parties to do more briefing and then get together and agree on three proposed hearing dates. They are directed to file a joint status report recommending further proceedings.
The Order says the joint status report should be filed by the parties no later than Sept. 21.
My view is that Gen. Flynns counsel and DOJ should take the position that they are the only two parties, and file a Joint Status Conference for just the two of them not including amicus counsel.
Amicus counsel was named by the Court to assist the Court. Amicus counsel is not a shadow party. Gen. Flynn and DOJ should force the Court to enter Orders directed to amicus counsel in a way that isolates Judge Gleeson as a non-party, or force Judge Sullivan to treat him as a de facto party rather than simply an advisor to the Court.

The minute order filed by Judge Emmet Sullivan outlines a protracted time-frame for the next sequence of events in the case against Lt. Gen. Michael Flynn:
As noted in the order, Sullivan is now telling the DOJ and Flynn defense to file a joint status report outlining their “recommendation for further proceedings” by September 21, 2020. From there a briefing schedule which will require both parties to respond to Sullivan’s personal amicus (Gleeson), and additionally respond jointly to any other amicus not ordered by the court. Lastly, Sullivan is requesting three dates for oral arguments.
In essence, despite his ability to quickly convene the parties to settle all matters before the court; which includes the unopposed motion by the DOJ and defense to drop the case; Sullivan intends to drag this case out as long as possible and use the amicus as a tool forcing responses from both parties (DOJ and Flynn). So much for the “quick dispatch” outlined within the DC Circuit opinion, this case is going on for several more months.

Barr and the prosecutor need to state that as far as they are concerned the matter is over and they will not respond to Judge Sullivan. Sidney Powell should do the same. If Sullivan proceeds to sentence Flynn, then Barr should state publicly that DOJ will not enforce Flynn’s sentence and that anyone who would try to detain Gen Flynn would be arrested and tried for kidnapping

Nice analysis. Sullivan got his marching orders from Zero.

Interesting, Flick Lives.
I rather imagine, though, that Hizzoner is using stalling tactics to get past the election, then close the case in some fashion.
Keeping this sham in play means the gag order on Flynn remains in place, as well. The guy who knows way more than he’s ever said is now muzzled, still.

Is this hack attempting to run out the clock to the General Election, hoping the Marxists win and declare war on all Trump supporters?

Sullivan can do what he wants, because the Swamp gave him permission to do so.
Its a racial thing.
Sullivan has cited crazy Left Conspiracy theories in Court - nothing happens.
It’s a Uniparty thing. Barr let “his” DOJ assault Flynn for over a year without lifting a finger against documented prosecutorial misconduct. Sulllivan knows there is no substantive opposition to his machinations. Obama’s team of Democrat thugs are free to continue assaulting General Flynn at their leisure through election day.

Thank you for clearing that up.
I never heard of ‘calendaring’ in my life but I guess putting an event on the calendar and scheduling it with the necessary parties would be an important distinction.

I believe jeopardy has already attached. Dismissal now means Flynn is protected by “double jeopardy”.

Good point, and always a possibility.
Be prepared though that the political machine will miraculously be granted standing to challenge the pardon, the lower court (judge sullivan?) will overturn the pardon and the demonkrap POTUS won’t appeal.

” means the gag order on Flynn remains in place,”
There is no gag order in place. This has been stated repeatedly, by his attorney.

This asshat judge is using delaying tactics to take this past the election date in the hope of Biden being elected. That doesn't work because Trump can just pardon Flynn if he loses.

We have learned over and over that any simple traveling county judge has more power than the President of the U.S. - at least as long as the appeals keep going.

Oddball thought, can Flynn sue for wrongful prosecution before the charges are dismissed? If I’m him, I need to sue for wrongful prosecution/misprision of office to make myself whole, but I can’t until dismissal. Guess who my targets would include? The guy who proposed using the Logan Act, which would be a huge black eye for Joe if filed before the election. I know he would never be deposed before November, but he would have to delay his answer at a minimum, and it would look bad.
I’m coming to agree, The DOJ and Flynn should immediately submit their proposed schedule of the 22nd, 23rd, and 24th.
To: bitt
Judge Emmett Sullivan is what I said in the beginning, an ardent democrat. He is fooling around with Michael Flynn’s case to keep it going until the November election. He knows in the end, the Supreme Court will throw out Flynn’s case, but he wants the propaganda advantage against Trump for the election. Judge Emmett Sullivan is a slob and should not be a judge!
