Limbaugh talked about this, this past week. He discussed the fact that this is not the first time that the Supreme Court has tried to assert itself as the ultimate power contrary to the Constitution.
But, he also discussed the fact that in the modern era it is the Congress’s gutlessness that has defacto granted the SC the power they have assumed contrary to the Constitution.
He further explained that this has been going on for so long now that most uninformed Americans just assume that this is the intent of the Constitution when it is not.
He explained that many decades ago the dems realized this perception among the people and strategically, began to focus on the court system as insurance for their political objectives so that when the tides shift and they lose elections they do not lose power.
Because the courts they packed right under the noses of clueless republicans and the misperception of the uninformed American public would ensure the dems of a power lever even if/when they lost elections.
Even in landslide losses.

But in the end Republican John Roberts helping the Liberals-Democrats run things with more 5-4 rulings recently and then Neil Gorsuch ruling against “traditional values” in relation to employment.
Gorsuch appointed by yes President Donald J. Trump.
I’m a libertarian regarding LGBT matters but all those religious voters told they need to vote Republican to get “conservative” justices on the Supreme Court have been hung out to dry and look like folks PT Barnum referred to as “suckers”.
Roberts swore in an ineligible Kenyan, twice, both times, one public, one private on both occasions.......
Roberts was not a surprise. W appointed him after his personal friend with weak judicial experience was rejected by almost everyone.
But, Gorsuch’s decision surprised everyone. Including the Federalist Society which put together the judicial appointment list of ideal conservative judges from which President Trump chose from.
This cannot possibly be blamed on Trump. Ths Gorsuch decision shocked the Federalist Society as well as longtime court watchers.
We got Alito after Harriet Myers was rejected.
Roberts was appointed before that.
Yes. I sit corrected. Thank you.
But, regardless, with a Bush appointment, disappointment isn’t really a surprise.
