Sunday News Roundup: Sullivan Lawyers Up, Cuomo Deflects Blame, and Trump Tees Off
DB Daily Update ^ | David Blackmon

Posted on 05/24/2020 5:57:58 AM PDT by EyesOfTX

If this surprises you, you haven’t been paying attention. – Federal Judge Emmet Sullivan, under fire for his bizarre conduct of the case involving the framing of General Mike Flynn, will not be filing his own response to the DC Circuit Court of Appeals’ order for him to explain himself by Friday. Instead, the Washington Post reports that he has taken the extraordinary step of hiring “a high-profile lawyer” to do that for him:

The federal judge who refused a Justice Department request to immediately drop the prosecution of former Trump adviser Michael Flynn has hired a high-profile trial lawyer to argue his reasons for investigating whether dismissing the case is legally or ethically appropriate.

In a rare step that adds to this criminal case’s already unusual path, U.S. District Judge Emmet G. Sullivan has retained Beth Wilkinson to represent him in defending his decision to a federal appeals court in Washington, according to a person familiar with the hire who spoke on the condition of anonymity because of the sensitivity of the matter. The U.S. District Court of Appeals for the District of Columbia Circuit is now examining the judge’s actions and the larger case against Flynn after lawyers for President Trump’s former national security adviser asked the court to force Sullivan to toss Flynn’s guilty plea.

Wilkinson, known for her top-notch legal skills and get-results style, is expected to file a notice with the court in the coming week about representing the judge. She declined to comment when reached Friday evening. Sullivan also declined to comment through his office.

[End]

Don’t you just love the phrasing? “high-profile”; “top-notch legal skills”; “get-results style;” the pathetic Post reporter must have just done a cut-and-paste from Wilkinson’s marketing flyer, which no doubt was stapled to the handy talking points memo that came in from the DNC.

So, what does this tell us? It tells us that Judge Sullivan is worried, very worried. The order from the DC Circuit demanded a response personally from him, not some “high-profile lawyer” with a “get-results style.” It also tells us that the judge who refused to allow the DOJ’s motion to dismiss the case is not confident that he is capable of explaining his own actions. Amazing.

The Post story indicates that Wilkinson plans to file a notice to the court that she will be doing the responding on the judge’s behalf, something the Circuit Court has no obligation to allow. This will be another very interesting week in the Soviet-style show trial of General Flynn.

“None of the men are wearing masks.” – President Donald Trump (I never tire of typing those three glorious words) drove the corrupt news media nuts once again on Saturday, simply by playing his first round of golf since early March. The automatonic ghouls at CNN and MSNBC tut-tutted about it all day long, obsessing over the fact that, while spending four hours in the wide open spaces, neither the President nor any of his playing partners and entourage were – gasp! – wearing masks.

Trump tees up controversy as he plays golf in a pandemic | US news ...

Oh, the humanity!

Not even Anthony Fauci is confused enough to pretend that wearing a mask would serve any productive purpose in that setting, and you can be certain that none of the TV talking heads, cooped-up in their enclosed studios with cameramen and production staff, were wearing masks while doing all the tut-tutting and tsk-tsking.

These are the worst people in our society. They truly are.

Yore attenshun good citizens! Tha Honorabull Rayaph Coonman Northam is a-gonna go visit tha beach and mingle with tha peoples down theyah! – Meanwhile, detestable Democrat Virginia Governor Ralph Northam was doing this:

Image

No one at CNN or MSNBC had a word to say about it. Funny how that works.

Living in a Democrat state is hazardous to your health. – No really, it is. Reuters compiled data showing that residents in “blue” areas of the country are three times more likely to die of the Wuhan Virus than residents living in the “red” areas:

Image

So, come on to Texas and Florida, folks, but when you get here, don’t vote for Democrats.

Speaking of dangerous Democrat governors… – Andrew Cuomo, in his frenzy to misdirect blame for his state’s thousands of nursing home deaths anywhere but in his direction, is now claiming that he issued his order forcing hospitals to send infected elderly patients back to nursing homes based on guidance from the Trump Administration:

Gov Cuomo blames Trump administration for forcing him to send 4,300 coronavirus hospital patients to nursing homes where 5,800 New York residents died New York Governor Andrew Cuomo has argued that he was simply following White House guidance on sending hospital patients to nursing homes ‘Don’t criticize the state for following the president’s policy,’ Cuomo said It was revealed Thursday that 4,300 recovering coronavirus patients were sent to New York’s already vulnerable nursing homes There have been more than 5,800 nursing and adult care facility deaths in New York This is a completely false claim. No guidance from the federal government or anyone else justified Cuomo’s unconscionable, ghoulish order.

But here are tools supplied by the federal government to New York that Governor Cuomo could have used to avoid sending those infected patients to those nursing homes, where they infected thousands more residents who might otherwise have avoided the virus:

A 1,000 bed Navy hospital ship that saw a grand total of 84 patients before leaving New York Harbor; A 2,900 bed field hospital at the Jacob Javits Center that Cuomo and Bill de Blasio barely used; A 500 bed field hospital in Brooklyn that also sat barely used. Let’s be crystal clear: Andrew Cuomo and Andrew Cuomo alone is responsible for the needless deaths of thousands of nursing home residents in New York. Period.

That is all.

Cuomo the Weasel, observed early on that the elderly were dying after being sent to nursing homes, yet he continued his despicable actions till more than 5,000 old folks died. This dictator, Fredo’s brother, is a scum bag.

cuomo is your typical DIMocRAT. They take great joy in murdering babies in the womb and, then, selling their body parts and fluids. Similarly, they took great pleasure in sending elderly people with the wuhan chinese death virus to nursing homes to infect others...thereby killing more than several thousand elderly people. I believe cuomo said derisively and dismissively: “They were going to die anyway”. How callous. How criminal. How typical and expected. Will no one hold him accountable?

I thought I read that the Court's order was specific in that Sullivan himself must answer and not fob it off on someone else...

This is the first tim I have heard of a district judge hiring an outside attorney to respond to an appeals court. What’s with that?

Extraordinary, unprecedented, bla bla bla. You see where this is going, Right? The Left will continue with their war no matter how much damage they do to Law.

The appeals court ruled in a way that allowed Sullivan TIME, instead of simply slapping his prevaricating ass down, or giving him 48 hours. That was clue one. The court also invited the prosecution to weigh in, implying debate, clue two. Now the court won slap this silly shit down. That’ll be clue three. A ghost prosecutor with staff? Sure why not, OrangeManBad.

Judge Sullivan

Seems there are 2 possibilities

1...Whom the gods would destroy they first make mad

2...Sullivan compromised...good guys take over...force the issue....resulting court case...General Flynn called as witness....Flynn unloads into the court record...miscreants arrested.

I’m betting this hack is incapable of authoring writ of mandamus. In fact a week ago he probably didn’t know what one was.

Judge Sullivan is the only person on the planet who can still rescue this scheme. He is being coached, aided, and directed by the crowd who is running this coup d’etat. His role was intended to be sentencing LTG Flynn to prison that would silence him at least through the upcoming election. He has already gagged him, so he has been unable to say anything publicly. Sending him to the big house would keep the gag in place.

Of course Sydney Powell has upset the applecart. In fact, she is destroying the entire plan and they are in a panic. But, they are not giving up, they can’t. The stakes are too high and the consequences of losing go way beyond this election.

For the coup d’etat crowd, Judge Sullivan is a little suspect. He has a reputation for following the law, at least from time to time. They can’t take a risk with him, therefore all of the reinforcements. Some of them are there to do the dirty work, and others are minders to make sure that the Judge does not go off the reservation. I think that they can’t pull a rabbit out of the hat, the decision has already been made and the circuit court will put an end to this nightmare. This last act will serve to prove how evil these people really are.

I suspect the Circuit Court won’t play along with this. Obviously they’ll accept the filing, then dismiss the idea.

There is nothing extraordinary about a judge being represented by counsel in a mandamus proceeding when he is the subject of the proceeding.

There is no telling what any court will do anytime under any circumstances.

Contrary to much speculation, there is another possible interpretation behind the court’s order to Sullivan, especially in light of their telling him to address Fokker.

Fokker is readily distinguishable from Flynn. IMO, and it is JUST MO. Fokker is 100% irrelevant to Flynn, just as Stevens was 100% irrelevant to Flynn. Apples and oranges irrelevant, not the fact that they all discuss fruit.

By telling Sullivan to address Fokker, the court (it can be reasonably speculated) seeks to clarify and distinguish the holding in Fokker, which has been widely and categorically “interpreted” to prohibit Sullivan from doing what he is doing.

I have yet to see a lawyer on our side do a legal analysis of Fokker in support of the “categorical” position.

Similarly, I have yet to see any lawyer on our side do a legal analysis of whether Flynn can be held in contempt for committing perjury to Sullivan’s face, or whether perjury was committed.

If the conclusions were so easy to reach, why have the lawyers just avoided analyzing the issue?

I realize any adverse happenings in the Flynn case will just be met with outrage, but there is an objective basis having nothing to do with politics or corruption which could be the reason for things not going Powell’s way.

You write like a first year law student, weighing in with your weighty thoughts. Let me put it simply - the Justice Department has dropped the prosecution based on the corrupt actions of the American Gestapo. It is not the right of a judge to cloak himself as the substitute prosecutor and he should be spending his own money for this lawyer, it should under no circumstances be that of the taxpayers.

That was true when it happened and it remains true now despite the spin. He is gleeful about sending babies to their doom, I wonder why he refuses to own these deaths? You broke it, you bought it Andy. Deathocrat in action.

A big question is how is the attorney getting paid, and if so, by whom? The fact that she has also represented big name Democrats is more than sufficient reason to disqualify Sullivan from the case.

Good question. About what?

A judge lawyering up in a case.

Don’t know that I have ever heard of a judge lawyering up happening before.

You are being logical and rational. This has the stink of politics and desperation all over it. In my view the court is ALREADY playing along with it.
