I imagine most won't read this far down to learn why he was "loitering" in the yogurt shop to begin with.
Sounds a lot like he was TRYING to get kicked out.
And I’ll bet you he knew his attorney ahead of time.
In Calif., it was a real trendy money maker for a time for lawfirms:
They’d get a van and a couple people in wheelchairs, then go to tiny wineries they knew were not ADA compliant. Then they’d boo-hoo and go away, rapidly expediting to the next one, rinse and repeat.
They could do maybe 10 in a full day.
Then they’d sue ALL those places, wanting NOTHING to change, just greedy for the settlement they knew would be forthcoming.
They did it HUNDREDS of times.
In the early stages, they were even talking about forcing GOLF COURSE SAND TRAPS to be ADA compliant..!
Cross a protected class person and risk being destroyed personally and professionally. They will utterly destroy you to increase their own power and standing in the community.
It is a systematic method of attacking the target.
Act outraged and horrified to elicit sympathy from strangers, since liberals tend to use perceived harm (and fairness) as their ONLY moral factors.
Demand an apology, as if that would solve the problem.
Use said apology as an admission of guilt.
Continue to browbeat person into submission and obedience to your demands. If others get involved, you can use the apology as proof that they agreed they did something wrong.
It is emotional blackmail by liberal bullies.

So was he sitting at a table with the mother and child he was overseeing? Or was he at another table and not obviously with them?
Get your video camera out and record him. Then threaten to post it on the internet.

I have heard of that kind of nuisance plaintiff.
There are many incidents of it from Santa Rosa to San Fran and beyond.
You say that it WAS a trendy moneymaker for lawfirms.
Has that changed? I hope so. I know there was talk in Sacramento to
punish abusers of this approach.
What’s interesting is that the owner’s name is Hispanic. Hispanics/Latinos better wake up: Blacks see them as part of the White Hegemony, not as “fellow victims,” and do not differentiate when targeting.
Perhaps if he is just doing his job, and is going to employ another business to do it, he should renumerate said business.
They got greedy:
They expanded to cottages, bed & breakfast places.
But they made a mistake:
They pulled it on a small ranch in Carmel, Calif owned by Clint Eastwood, who as you know has big bucks. I think it was the Carmel River Inn, maybe.
A really nice guy, but he’s a libertarian and harbors a special hostility to stupid reg and greedy lawyers.
He made it really, really expensive on them, even bringing in some astronomer, who based on the photos of the plaintiffs “so sad, there, on that day they had their hearts SET ON enjoying...” demonstrated they could not have been there at the Ranch in the season alleged; the shadows were all wrong (I think some clock was also in the background, etc).
So they pulled in their horns a bit, after that expen$ive misadventure.
I heard later the new money maker was PARKING LOTS of malls that were not patrolled; people getting hit, falling down, struck by carts, etc.
That’s why in Calif now so many mall parking lots (eg WalMart) has video coverage.
Those are Dirty Deeds, but they are not dirt cheap!
He was directed by a court of law to accompany they mother and child.
He could not disobey the court, and must fulfill the obligations of his job.
He had no choice but to be there.
A small food business has a reasonable expectation that their tables are to be occupied by paying customers.
He could not violate the dictates of his job, nor could he violate the court order.
If he would have told the employees why he was there, he would have vilolated their confidentiality, broken the law, and would have been fired.
