If you didn’t hear about this last month, it’s for good reason. The media do not like publicizing defeats for the American Civil Liberties Union (ACLU).

A 27-year battle with the ACLU over the Mt. Soledad mountaintop cross at a Korean War veterans memorial in San Diego ended in a victory for American heritage. The Ninth U.S. Circuit Court of Appeals issued a one-page ruling calling the case moot on Sept. 8 and directing U.S. district judge Lawrence Byrne to dismiss it, which he did on Sept. 13.

The rulings cite the Mount Soledad Memorial Association’s purchase of the 29-foot cross and the land beneath it from the Department of Defense for $1.4 million in July 2015. The transfer was facilitated by legislation sponsored by Rep. Duncan Hunter (R-Calif.), a former Marine who represents California’s 50th District, which includes San Diego.

The ruling leaves intact the familiar sight of the imposing cross above the Interstate 5 freeway in La Jolla, and in effect sends the ACLU packing. Can’t you just see the poor, dejected ACLU lawyers stomping down the mountain and throwing their axes into the backseats of their hybrids?

The final outcome was not that surprising, given the U.S. Supreme Court’s ruling in 2010 in Salazar v. Buono, which approved the sale of federal property to private ownership at a California veterans cemetery. That case involved the Mojave Memorial Cross, which the ACLU tried to tear down on behalf of a retired federal park official who had moved to Oregon but said he was still offended by the 7-foot-high pipe metal cross.

Looks like the ACLU still lies about the “CL” standing for “Civil Liberties” instead of “Communistic Litigation”.

Grew up in San Diego and have been aware of this anti-Christian case from the beginning. Nice to see it end in favor of religious freedom not religious bigotry.

I hadn’t heard this either! For years I had been kinda keeping up with this, as I was one of the Soledad Cross supporters in the 1990’s.

The ACLU was working to the aims of the militant atheists who, like unto the vampires of myth, recoil in horror from the very sight of the cross.

The modern atheist's desire to be protected against anything that smacks of anybody's religion (but most particularly Christian) in the public view, and to claim this as a civil right bends the concept of civility like a pretzel. Atheism, of this scope, is as militant and malignant a religion as any other espoused by unreasoning fanatics.

In short and to use modern terms, an atheist in todays world, wishes to expand his/her 'safe place' to be the norm and force all non-atheists to hide themselves like lepers. Few things are as far removed from the tolerant view of 'live and let live' as this BUT it appears to be increasingly the view of progressive leftism as well as atheism (a repetition for the many that are both)!

I am very glad to hear this. At one point in my life I drove right by the monument on my way to work every morning. The scenery was breathtaking and it didn't take one second longer than using I-5 like every other shlepp around there.

A truly beautiful place.

It always amazes me how folks buy into the communist mentality as if there will be no one in power, as if it will be pure. It has never been that way, and never will be. Just the power-hungry duping the idiots into taking others’ property and liberty. Amazingly stupid.
