No, the only material fact is what the law was then, in 1970, in the United States when Cruz was born.

He's screwed then too, because being naturalized by congress at birth does not make you a natural born citizen. The founding fathers also only recognized natural born citizens paternally, through transmission from the father. Cruz's father was a Cuban Canadian.

That said, it seems the point of the article is questioning whether Cruz was even declared a citizen at birth by his parents, who would have had to have declared his citizenship at birth.

You base this claim on perhaps the US Constitution?

You are simply wrong.

Congress was given power to define by statute.

Define does not mean “naturalized” by statute.

It means defined by statute.

All of these imaginary hoops you people claim are necessary are fantasies of someone’s imagination.

He was born to an American mother when she was working in Canada.

They returned to the United States and he grew up here.

That is ALL that is necessary.

But no matter, just keep whipping and beating that poor horse.

It will get you nowhere.

All of this has long since been dissected and plumed by scholars and no, Larry Tribe the Democrat hack, and the ignorant (or IS he?) DT don’t qualify.

I don’t know or care what Canadian law is. U.S. law recognized him as a citizen at birth (which is the same thing a NBC, despite the pitiful attempts to demonstrate otherwise.)

If his parents didn’t file for the consular report before he turned 18, he can file for a certificate of citizenship. If he has had a U.S. passport (and I believe I read somewhere that he had) he has already presented some evidence that he is a citizen. I am going to assume it is the citizenship he inherited from his mother at birth until someone shows me something that proves he was naturalized.

Oh, please. You are wasting your time on these ignorant Cruzbots. They think they know the law, and yet, they don’t. All Ted had to do was present a paper from the U.S. Consultate, which he has never done. Instead, he submits his Canadian birth certificate. Well, duh - that isn’t in dispute, and has his other records sealed. So, one must assume he is hiding something significant. Gee - I w wonder what that might be?
