Did LaVon have a legal obligation to stop for the police?

Many years ago I was a passenger in a car driven by my brother. He cut off a car leaving a gas station, the car followed us about 1/2 a mile to our destination. The occupant got out, ran up ripped open the drivers door and pulled my brother (a smallish 16 year old at the time) out of the car bodily. Turned out the fellow driving was a LEO (Harbor Master) in an unmarked car. He was also not in uniform. Shortly there after a marked police car showed up, with uniformed police officers.

The police wrote my brother a ticket for failure to yield to a police officer or some such. The ticket was thrown out by the DA when my brothers lawyer pointed out that in Michigan one is only required to stop for either an officer in a marked vehicle, or an officer in an unmarked vehicle in uniform. Mere flashing lights and guy in blue jeans is not sufficient (or was not at the time) to indicate to a driver that they were required to stop.

Now, look again at the video of the police ambush in Burns. In both the first stop, and the subsequent roadblock ambush. In the first stop the two vehicles pulling him over appear to be completely black with no markings. They have no lightbar, only a couple flashing lights behind the grill. We don't clearly see the people in the vehicles. Were they in recognizable uniforms of the local police or State Patrol? Or were they dressed all in "ninja black" perhaps with POLICE stenciled on the backs of their uniforms?

In the second stop you have three trucks blocking the road, none appear in the least bit to be law enforcement vehicles.

You know you are supposed to stop for vehicles marked like THIS:

And obey the lawful commands of people dressed like THIS:

First, lets look at the vehicles used in the initial stop:

They have no visible police markings, do not have lightbars, and do not look like and typical unmarked police vehicles (such as the ubiquitous plain white Ford Crown Victoria). The only indicator of them having an official function are the one red and one blue flashing lights hidden in the grill.

Now lets go to the roadblock used to facilitate the ambush. there are No visible police logos in this picture, at the second stop:

I do not see any flat brimmed police hats.

Also, not the absence of road flares, safety signs, warning cones or any other device warning motorists to slow down. Any tow truck driver in the state would do a better job of marking a road closure than these guys did.

In summary it is not at all clear to me from looking at these pictures that the drivers of the target vehicles had an obligation to stop at either juncture.

Should LaVon's family choose to bring suit for his death I think they will have a good case based on the flagrant failure of the supposed law enforcement officers to properly identify themselves.

According to the survivors there were no commands given via PA at the first stop either.

If I were stopped on a rural highway in the middle of nowhere by two black SUV's with no markings, non-uniformed drivers, and given no identification or verbal commands I would probably drive away too.

The behavior of the US law enforcement in this respect is reminiscent of something you would see in a Latin American country, where police act as free-lance strong arm units, operate shadowy death squads, and use poorly marked roadblocks for nefarious purposes.

This is not in the tradition of American law enforcement.

This was not a pursuit following a crime (such as a bank robbery or something) where in emergency un-marked or civilian vehicles might be pressed into service. This was a highly planned operation that included air-support. Given that one can only assume that the choice of using all unmarked vehicles and non-uniformed officers was intentional.

Why? My surmise is that they hoped to engender exactly the response they got, to escalate what should have been a simple traffic stop into a "felon fleeing arrest". It certainly has many indicators of a pre-planned setup with malicious intent on the part of the agencies directing it.

They were on their way to talk with a sheriff, it’s not like they were going to rob a bank. It could have been handled better.

The trap was set, the trap was sprung. They were shot at so they fled, flushed directly into the kill zone. The plan worked perfectly.

There should have been a better plan.

Conjecture. Understandable though, as that's the narrative LEO would have you believe.

Neither you nor anybody else who has viewed this video knows for sure whether Finicim was reaching for a gun (after raising his arms in surrender) or reacting to being shot.

I watched on WeaselZippers where their windshield was shot 4 times and he got out when he could to save those in the vehicle besides himself. Now I didn’t know that if you made a statement not to be imprisoned the LE community were authorized to shoot you 9 times including in the face precluding an open casket. Watch that guy by the vehicle slink away after firing. I don’t wish to be imprisoned in an 0 “FEMA” camp so does that mean I am a target for perforation like a rabid animal? This is not right and evidence will likely be with held showing what really happened. This is like all the HRT guys saying they would have taken the Vicki Weaver shot - for what other than blood?

This is the first comment I made when i heard about the entire assassination.Did these guys even have probable cause to make the stop?Appears they did not.Someone needs to hire a really good attorney and go to town.

Looks like a “Marine Style Cover” with a peak on the front, certainly not a flat brim or ball cap OSP.

It's understandable because it FITS THE FACTS, not merely what someone wants to believe.

A) Finicum regularly wore a 9mm in an under the shoulder holster.

B) Finicum attempted to flee a police stop

C) Finicum pulled his coat back with his left hand and reached toward that area with his right hand.

D) Finicum stated he would not go to prison.

If you attempt to run from a police stop, crash through a roadblock, are know to armed and have publicly stated you will not be taken to jail, you're going to get shot trying to reach under your coat.

We have to ignore all of what Finicum said, and what he did, to arrive at the conclusion he was 'murdered' by the police. He made a decision he was willing to die with, but some on FR would rather believe he was a liar.

OSP said clearly he went for the waistband. That is where he kept his imaginary six shooter. He must have been pretty sure his fantasy weapon would take care of things. He swerved to avoid hitting the roadblock. The Lord blessed him with the lives of the women who were spared despite efforts of OSP to kill them. He certainly was wrong to ignore commands after being tasered and shot in the back. He should have kept his hands up. What a dummie!

Robert "LaVoy" Finicum, spokesman for the occupiers of the Malheur National Wildlife Refuge, was yelling "just shoot me" before he was shot and killed by police in a traffic stop, according to a woman at the scene.

Fleeing the police, crashing a roadblock, and then shouting "just shoot me" while reaching under your coat is called 'suicide by cop'.

The fantasy was that this protest was going to change government policy or spark a popular revolt.

He did not crash a roadblock, he swerved into a snowbank. He has women in the car. Swerving save the two women. After being shot three times and bleeding out, instead providing assistance OSP empties a hand gun into his body I guess they were yelling at him to get up on his knees and he didn’t obey. OSP says to themselves, he is not obeying lets put 6 more holes in him then we can murder the women. That will lots more fun.

The hell with that.

IF audio is combined with video and we hear shots AFTER he is reaching across then I’ll admit I’m wrong.

Until then, I’ll believe Finicim’s own words in which he stated he would not use his weapon unless he was being shot at.

So we know that the persons in the truck believed they were being shot at and believed they were likely going to be killed, so they fled.

Not according to this interview with Victoria Sharp.

According to her, Ryan Payne said he had been fired at, but then got out of the truck and surrendered. He wasn't gunned down when he did so I'm not sure what the others in the truck were afraid of.

LeVoy and the others in the truck then sat around discussing whether they should flee or not - which I doubt they would have done if they thought they were under fire.

Eventually, LeVoy decided to bolt and here we are.

Finally, neither Ammon nor anyone else detained in the initial stop has claimed that anyone was firing at the other truck. Why?

I just heard that the FBI released the SN on the 9MM he was supposedly carrying. It was a gun stolen 2 years ago. Since Lavoy could purchase his guns legally it is doubtful he stole or bought an illegal gun. At the refuge, they said Lavoy left his guns there. Did the FBI plant the 9MM on the body? Probably...

"The people in the truck were discussing what would happen if Finicum drove off, Sharp told CNN. The FBI said its agents and state troops gave verbal commands for the truck occupants to surrender.

LaVoy Finicum remained determined to try to see the sheriff on his own, said Sharp. "And then he said, 'Hey guys, I'm going to drive.'"

Shawna Cox told her to get down, Sharp said. "'They might shoot when he starts driving,'" she says Cox told her.
