From my understanding, only 40 out of 30,000 emails on her server were randomly inspected, and 4 of those had top secret clearance.

So removing the TS is only part of the major crimes committed.

We don’t know that. All we know is what Hillary authorized to go out in the email to her supporters. All of which has been proven to be utter BS. So, no, nobody stripped anything off, it’s a smoke screen

removing the classification tag from a document doesn’t declassify it.

she knowingly received classified information via unsecure channels.
she set up those channels.
she goes to jail.

anyone that removed the clearance tag should also go to jail.

it’s really not that complicated.

This should be very easy to prove. Just look at the original sender of the classified e-mail. If it was marked Classified she is toast! Even if it was not marked; I would think someone holding the position of SOS would consider anything they sent or received classified.

I am just amazed that while the dems and media do this kabuki dance on classified materials, no one is really talking about a Government employee setting up their own private e-mail server/system to conduct Government business. Why hasn't she been charged? The dem talking points are everyone else did it so why is this an issue.

Hillary is pretending to be the President of the United States, responsible for the entire Executive Branch of the Federal Government. With this issue, it doesn’t matter who stripped the classification markings, she is responsible for what happened. She made the decision to ignore law and regulation and create a secret and private email system. What ever happened on that system is her responsibility and she should be held accountable.

A second point is that Hillary is no dummy. No doubt she see the same email on her secret system stripped of markings that she saw on a government system, or in print. She had to know that she was looking at the same document, altered to deceive and cover up what they were doing.

From an IT perspective, I’m not even sure how you would do that. Of course, I don’t use the government’s e-mail server, so I’m not familiar with how they mark or unmark items classified.

The original, classified information could be only handled inside a SCIF, on computers that are installed there and connected to whatever secure network they may be connected to, through the encryption hardware. One would presume that the State Dept. has a good number of SCIFs, as most of what they do is expected to be classified in some way.

If we presume that the secure computers don't have USB ports or other I/O that is suitable for exfiltration of information, then the criminal could smuggle a cell phone into the SCIF and capture the screen with a camera, or just retype relevant parts of the message into the phone. This would also remove classification markings, as they would not be copied. Naturally, phones and other such equipment is not allowed into a SCIF. But who is going to search high-flying officials of the department?

The easiest way to find out who sent the stolen classified information is by looking at the headers of those emails. They say something like "from:jane.doe.123567@abc.def.us.gov" - and you can take it from there. Given that there are many such emails, the senders are going to die in prison unless they make a deal with prosecution - and that means revealing the whole scheme. Managers are well known for insisting on their own IT solutions, but here the senders had to commit an obvious federal crime. What were they thinking?

The Sec of State, like other cabinet officials, is delegated classification authority pursuant to Executive Order 12958. That classification authority is for all data, be that data received, stored, or transmitted.

If the data was classified and not so marked, she was negligent and in violation of the EO.

If it was marked classified and was not actually classified, she was negligent and in violation of the EO.

Further, see the “limitations” included in that Executive Order and further promulgated in the State Dept’s own classification guide. It is highly likely she was in violation of those limitations also. For example, simply classifying information that might be embarrassing.

She didn’t send or receive any emails which were marked classified at the time.

Always thought that was a very suspicious way of phrasing it. Now we know why.

Hillary KNEW that the documents she received were classified, but had the classification removed from the copies she was getting. That way, they were not marked classified at the time she received them.

And since she is Clinton, keep in mind she also said “sent”, meaning she sent them to someone who was not authorized to have them. She wasn’t sending them back to the State Dept., she was “spying”.
