If arraignments arent held within 24-48 hrs, (SCOTUS says 48 hrs) a release can happen. But, the charges can be filed later with a rearrest. And, theres a possibility that police may find evidence in the home or on the person (illegal guns, drugs, etc) during the rearrest that could result in further unrelated charges.
