Habersham County, GA On May 28th, a SWAT team executed a raid on a home where a confidential informant (a criminal who trades information for a reduced sentence) told them he bought drugs. The CI said there were no children in the home.
When police raided the home, it was found that the person they were looking for did not live there. No drugs were found in the home. However, there was a victim, a 19 month old baby who was sleeping.
SWAT officers threw a flashbang directly onto the baby resulting in severe burns that required weeks of treatment. Now, the county is refusing to pony up the cash for the childs mounting medical bills which could easily be in the tens of thousands of dollars at this point.
Not only is the county refusing to pay, they are saying its against the law for them to do so. The Habersham County attorney provided the following statement,
The question before the board was whether it is legally permitted to pay these expenses. After consideration of this question following advice of counsel, the board of commissioners has concluded that it would be in violation of the law for it to do so.
The family of the child plans to sue the county if necessary. An independent investigation conducted by the familys attorney found that officers used faulty information to obtain the search warrant used to conduct the raid.
