I agree with you theoretically 100%. But getting federal judges on the case who are sympathetic to the plaintiff's position might be problematic in the Age of Obama.

After seeing Cummings react SO QUIETLY to a witness today it’s pretty clear that he is now wondering “... what rough beast, its hour come round at last, Slouches towards (Cummings’ personal) Bethlehem to be born?”.

The House Ethics Committee should investigate this CRIMINAL activity conducted by Cummings, along with other Congressional DimocRATS (AND THEIR STAFFS), as they led this racketeering enterprise to have the Federal Bureaucracy target individual Americans designated as DimocRAT enemies. Cummings and all the other involved conspirators need to pay for their crimes, lose their jobs and pensions and be sent to the appropriate prison.

And they cannot let the Congressional DimocRATS on the Ethics Committee drag their feet. They should be pulling the email records of Cummings and his staff TOMORROW. And that is just the start. Follow the breadcrumbs, including private email and phone records of the conspirators, whereever they lead. NO MORE DELAYS. BOEHNER, THE HOUSE OF REPRESENTATIVES HAS THE POWER TO GET THESE EMAILS—DO NOT HESITATE.

In case you forgot, Leftists filed RICO charges against the Pro-Life Operation Rescue. Now if they were able to do that why can’t some legal genius on the Right use that same law against the Democrats and IRS!!

Senate Democrats facing tough elections this year want the IRS to play a more aggressive role in regulating outside groups expected to spend millions of dollars on their races. In the wake of the IRS targeting scandal, the Democrats are publicly prodding the agency instead of lobbying them directly.

Dems are also careful to say the IRS should treat conservative and liberal groups equally, but they’re concerned about an impending tidal wave of attack ads funded by GOP-allied organizations. Much of the funding for those groups is secret, in contrast to the donations lawmakers collect, which must be reported publicly.

One of the most powerful groups is Americans for Prosperity, funded by the billionaire industrialists Charles and David Koch. It is inherently an internal revenue matter,” he said. “There are two things you don’t want in political money, in the fundraising world and expenditure world. --SNIP--The House Ways and Means Committee Republicans have not ruled out its “inherent contempt” authority to arrest former IRS chief Lois Lerner if Eric Holder continues to refuse to act on the panel’s vote to seek an investigation of Lerner and her role in the IRS targeting scandal.

The Washington Examiner reports, House Speaker John Boehner (R-OH) spoke about the committee’s threat to hold Lerner in contempt: "The Ways and Means Committee, led by Chairman [Dave] Camp [R-Mich.], has conducted a serious and thorough investigation of the IRS, uncovering abuses and criminal acts that should be prosecuted to the fullest extent of the law."

"As I've said, if Lois Lerner continues to refuse to testify, then the House will hold her in contempt. And we will continue to shine the light on the administration's abusive actions and use every tool at our disposal to expose the truth and ensure the American people get the answers they deserve."

The constitutional “inherent contempt” authority gives the House power to hold Lerner until a new Congress is convened in January 2015, which could then renew the subpoena if she continues to refuse to testify, though Republicans are not emphasizing that option.

Rep. Kevin Brady (R-TX) told The Washington Examiner, "I think we'll deal with that, should that occur, but I think this too is an ongoing investigation, and, frankly, for the attorney general to turn a blind eye to this evidence would discredit him greatly.”
