The open carrier was cleared of all wrongdoing after the police viewed the surveilance video. From opencarry.org:The security video tape was reviewed by the investigator and my leo buddy. I have been cleared of any wrongdoing and it was an unwarranted 911 call. The incident has been pushed further up the ladder. I am sure that the needless backups will have to be addressed. Got a call from my leo buddy from Prescott this evening. Employee fired.Recently, a nasty situation developed with a young man legally open carrying a rifle in San Antonio after dark. The rifle was slung across his back. Open carry of modern handguns is mostly illegal in Texas. There is video at the link:
San Antonio Police Department officers from the West Substation responded to what they claim was an individual waving his rifle around and pointing it at people. Nothing could be further from the truth.The young man, Mr. Vichique, was tazed, arrested, and charged with a local ordinance that is almost certainly invalid under the Texas pre-emption law.
Unfortunately usually only filed as a class B misdemeaner for filing a false police report when they can have devastating consequences on the victim.
In other words, beware your disgruntled liberal neighbor.
Fortunately where I live the city attorney will press felony charges against anyone who makes a false 911 call that results in an innocent taken down, who then acquires standing for a subsequent civil suit.
I have always been of the opinion that the way to handle this problem with minimum fuss and muss, and total justice, is the no-brainer make the false accusation penalty identical to the falsely accused action.
Strange, that the accuser is always treated like a misbehaving child, ignoring the potential lethal consequences. "Well-meaning" never justifies creating mayhem triggered by functional imbeciles.
I’m not really sure you want to go down that road. For instance, if someone falsely accuses someone of a capital murder, do they really deserve the death penalty?
I got no real problem with that. However, you slice it, it’s attempted murder.
Although, I would prefer to see false rape and other sexual complaints get the same penalty.

Yes. After all, their lie could have led to an innocent person to be convicted of murder...
