Somehow I doubt pleading the 4th will be equally effective.

These authorized home invasions need to stop except in exceptional circumstances.

Oathbreaker got killed doing an unconstitutional attack on an American citizen's home. Nothing more than that.

Every cop that does a no-knock should live in fear that they will eat a rifle bullet. It's the only thing that will stop this unconstitutional nonsense.

A lot more of this needs to start happening.

[ You know things are very screwed up when home invaders yell “Police” to confuse and help overwhelm the residents. In this country, the residents should know (and used to know) that the policed don’t behave like that. ]

Yes especially in Texas, a border state, who knows if it i is actually a police officer SWAT team who got the wrong address or one of the Border Drug cartels who got the wrong address and are looking to put some heads in a bag....

A reasonable response that would very likely get you charged with capital murder.

And a reasonable verdict will be not guilty followed by a civil rights law suit and subsequent victory.

“No knock” warrants should be unconstitutional. Unless somebody identifies themselves as a police officer, how the hell is anyone to know who they are? This is equivalent to cops using unmarked vehicles at night to tailgait a vehicle until it goes over the speed limit, then try to pull it over.

This is just another case of cops abusing their powers and I have no sympathy for the cop. Case should be dismissed.

[ With so many laws on the books can ANYONE be certain they are model citizens immune from such ‘official’ behavior?? ]

In some ways I would rather live in a tyranny of a supreme dictator with a few laws vs. a Tyranny of Selective enforcement of many numerous contradictory laws because the tyranny of selective enforcement of a multitude of laws is more insidious than overt dictator ship because people living in it are mostly unaware they live under tyranny in the first place...

Don’t think we are talking real combat body armor. The LEOs like to dress up and play SWAT but they prolly do go as far as real combat body armor.

I’m talking deer rifles, which is probably what this dude had standing in the corner. Don’t know about SAPPI pads but a 30:06 is higher powered than an AK and I would not want to have one hit any wearable armor. Not even considering penetration, the impact could do one in.

Gee, that's too bad. Maybe he should have knocked and announced himself?

Cops are like doritos - they'll make more.

The SWAT team enters the trailer and the guy shoots a deputy. Why didn’t the other SWATs shoot and kill the guy and his pregnant girlfriend?

I would do the same. Breaking in unannounced is your death sentence. ,P>Thing is, crooks announce them selves as cop while kicking it the door too.

Decisions, decisions.....

If an officer wants to talk to me they will knock politely at my door in uniform with credentials. Depending on why they are there we may have a short conversation on my doorstep, or they may be invited in and offered a refreshment. Anyone breaking down my door in the middle of the night will be considered a hostile intruder and deadly threat to my family, and will be treated as such. It is up to LEOs to decide how you would like to interact with citizens.

Do you have any reason to believe a verdict in this case would be reasonable?

For instance, do you know of a single case where this strategy has worked?

If not, why do you think it would work for you?

There is a difference between what “should work” and what “will work.”

IMO the guy they went after is a scumbag, but not one worth dying to get.

A drunk, a pot smoker who grew a couple of plants for personal use. A ne’er do well, but one who has the right to sleep at night without getting his door broken in.

They could have searched his joint next day, but no they wanted to play Ninja.

It was a matter of time before some cop was killed doing this. It doesn’t make sense.

This guy was a low priority azzhole. Probably handed a cop some zhit on a traffic charge and they were seeking payback.

I believe they will have a hard time convicting him of Capitol Murder. Even if he deliberately shot the first cop through the door the situation is wrong. Proving it deliberate will be impossible.

“Cops have forgotten that no-knock entry was intended only to prevent evidence from being destroyed. “

From listening to these guys in the gym before Homeland Security financed their own gym, here’s my take. They LOVE doing this. It’s a super adrenaline rush. They get extra pay (or hazard pay, not sure which) for being on the team. They love the camaraderie of shared danger. When discussing it they’d get really animated and excited.

I’ve written about this before, the local sheriff broke in the door (my door) to arrest my elderly renters. They dragged them off and left the door on the floor exposing an entire household to theft. (The neighbor came over and propped the door back up so it looked closed.) They didn’t contact me or offer to pay for the damage. These people had a history of domestic abuse but had never used a weapon. They had 48 12’’ tall pot plants which the sheriff valued at ...$50,000...(No kidding.)

Three deputies had been there earlier and, according the sheriff’s spokesman, “put the couple to bed because they were too drunk to stand.”

So, why didn’t the three deputies who spotted the pot plants while on the call instead of putting them to bed put cuffs on them? Why did they have to knock down my $500 door and expose them and their dog to possible injury?
