On December 19th, a sheriff’s deputy was shot and killed during an attempt to serve a “no knock” warrant near Sommerville, Texas. Just before 6:00 A.M. an 8 member SWAT team broke through the door of Henry Goedrich Magee to serve a warrant which would permit the team to search the mobile home in which Magee and his pregnant girlfriend were living. Reacting to the pre-dawn, forced entry Magee grabbed a rifle propped against a bedroom door frame and fired at the unidentified intruders, killing 31 year old sheriff’s deputy Adam Sowders. No one else was injured and Magee was taken into custody. He is being held on $1 million bail and has been charged with capital murder, punishable in Texas by life in prison without possibility of parole or death by lethal injection.

These are the broad facts of the case as first reported by a number of print, radio and TV sources. The following additional information has been made public during the past few days:

1.) The “no-knock” warrant was issued at the request of...

Someone comes busting into my home unannounced at an odd hour, I’m gonna shoot first and ask questions later, too.

I would have a hard time as a member of a jury to convict a citizen who killed an officer during a no-knock warrant incident.

“Suicide by citizen” would be the operative thought for my judgement.

A reasonable response that would very likely get you charged with capital murder.

In reading the story provided at the link, it appears the correct person was killed.

I’m sure that there is a time and a place for a “no knock” warrant, but this certainly doesn’t look like it- and the aftermath demonstrates it may have been a mistake.

Sometimes I think law enforcement like this kind of tactic for the drama and excitement.

Based on the info in the article, I would not convict this man if I were on the jury. A man’s home is his castle.

This brings up an interesting point of why police are permitted to force themselves into one’s home with a batterning ram in this home of the brave and the land of the free. In is vaguely remesencent of the KGB and Gestapo techniques used in the past.

District Judge Reva Towslee Corbett. - If she is localy elected, she should be replaced.

Too many elected officers are under the impression that they AND ONLY they have all of the answers.

And there is way too much militarization of the police - who are NOT there to PREVENT crime - as stated publicly on many occasions.

I would have killed the SOB”s too. Anybody breaking into your CASTLE deserves all they get!If on the jury ,I would not charge him with anything but self defense!

No Knock Raids... Another legacy of the War on Drugs. I supported the WOD for years, but today I would say “No, the damage to the civil rights and liberties of the citizens of the United States far outweigh any benefits gained from the War on Drugs.”

And it must go into the ash-heap of history as a good idea gone wrong.

Sounds to me like a deputy was killed because another deputy had a severe case of illusions of “no knock” grandeur based on another investigator’s “big drug find”. Barney Fife on steroids.

The “no-knock” warrant was issued at the request of Deputy Sowders

And he was also the one was killed - his decision to have to have it cost him his life

I hope this incident dampens enthusiasm to use SWAT teams to serve routine warrants in the future. They could have just waited until the suspect left the house at any time and searched the home. I believe this guy was placed in a situation where he thought he had to defend himself and his girlfriend. I do not see anything wrong with what he did when faced with a bunch of unknown men busting into his abode during hours of darkness. The authorities need to stop using SWAT teams to handle routine situations.

One thing they obviously don’t have enough of is violent felons that have numerous convictions and could conceivably best be taken down by a no knock raid.

This guy had a prior for drunk driving and misdemenor pot possession and they break down his door In the middle of the night?

The police chief, the judge., and the DA need to have their heads examined
