I hope if you bother to comment, that you bother to watch the whole video. Yes I know it is a little long but this is OUR America. This is what many posters on FR defend. I would ask those of you who believe in a strong State and a strong Police to reconsider.

I'm no fan of cops pushing their weight around and harassing folks, but this kid didn't know when to shut up.
All of the advice from lawyers ACLU types tell you to ask if you are being detained or free to go. If the latter....leave immediately. If the former you can be detained until they can ascertain your identity.
You should have askes the question..if the answer was no, you should have left the area immediately.
She thought you were smoking, which I am going to assume was prohibited in the area you were in. So she was manufacturing probable cause to detain you if necessary.

Cops shouldn’t expect people to be nice to him. If he was a jerk, he was a 5th amendment jerk. Cops hate that more than anything because they are trained to wheedle incriminating information out of people. He frustrated that puir lil thing.

Naw he was hassled for being young. The loitering thing was an obvious afterthought. She was just trying to get back at him for asserting 5th amendment rights. Cops hate the 5th almost as much as they hate the 4th.
After a bit, I felt myself wanting to reach out, slap the kid and tell’em to stop acting like...well...a punk kid.
During the last part of the video he began this sophomoric taunt. Tasteless.
Could have been a bit more intellectual...but hey, that’ll come as he grows a bit.
Smoking, loitering, or being an A-hole?
He had much of the right idea, asserting his rights and asking if he was free to go? Good moves. Then he kept talking and talking. Bad move.
How many anti-smokers voted for legal marijuana...when will MADD or something like it go after stoned drivers...so far the Juveniles are wining...smoking is fine it it is weed.........
Doesn’t matter if he was sophomoric. Makes no difference. 5th Amendment says you don’t have to say anything to the cops. the corollary is that invoking the 5th amendment cannot be used as probable cause. However it is. Often. This should be a training video of what NOT to do as an officer.
Officers routinely trample the 4th amendment and the 5th amendment. That is what they are trained to do. Skirt, and intimidate. Many people are cool with the practice of subverting the 5th and 4th amendments of the constitution as lawfully enacted.
Cops need to earn respect. It is not guaranteed. Cops need to reclaim their honored position in society. Cops once were seen as protectors of the weak, guardians of public and private property and heroic figures who will jump into the malstorm to save the innocent. Now? Not so much.
However it is not incumbent on me, or anybody else to respect cops. It is the responsibility of the Law Enforcement community to regain it’s former stature.
This is not a good way to earn back that respect.
He'll learn this over time. Nothing good will come from taunting the cops. Nothing.
The point you miss is called urban camouflage. Live for another day. Do not lay all your cards on the table for all to see. Play the game. You know your playing them, they don't know your playing them. Walk away for another day.
I do agree with your overall points regarding official abuse of the 4th and 5th amendments however.
Unlawful detention? Violation of civil rights under color of law? Hope he sues the #### out of that PD and those two cops personally.
