FL:Robber Blunders, is Shot

La'Tay McKelley, pictured above, has been charged with attempted murder and armed robbery of Cortez Coins in Ellenton, Florida.

La'Tay, according to surveillance photos and the shop owner, attempted to rob the store and shoot the owner. He pulled the trigger at least three times.  When the pistol failed to fire, he pistol whipped the owner before the owner shot La'Tay.

Fortunately, La'Tay has either not had instruction in proper pistolcraft or did not pay attention when instructed.  

The pistol, easily identified because of the distinctive ventilated rib and sights, is either a Phoenix Arms HP22 or HP25.  The HP22 is the more common model.  A peculiarity of this model is that it has a plethora of safeties, including two manual safeties.  Almost certainly La'Tay forgot to disengage one of the safeties, something that I have often seen students do during training exercises.

Another possibility is that La'Tay simply forgot to load the pistol, or to rack a round into the chamber from the magazine.    This model also has a magazine disconnect safety, so if the magazine was not fully seated, that would cause a failure to fire.  The pistol has a reputation for accuracy and reliability, if you remember to disengage all the safeties.

The most common fault that I have observed is for the shooter to forget to disengage one of the manual safeties, which seems likely in this case.
The intended victim did not give La'Tay time to do more damage or to troubleshoot the failure to fire.  The shop owner accessed his own pistol and fired on La'Tay, wounding him. 

A hit seldom results in instant incapacitation.

 La'Tay fled the scene, but was arrested the next day, based on the surveillance tapes and the gunshot wound.
The owner's head laceration was treated at the scene.

If the trend in states is to let citizens arm themselves, criminals may chose to shoot first and then rob. Storeowners that deal in valuables need to prep to the new criminal trend. If I want to rob a jewelry store, I can assume the owner can be armed. So instead of walking in and announce a robbery, I go up to the clerk, smile and ask to see a ring and as the clerk is in the process of getting the item from the display, I pull out my gun and kill her/him on the spot and shoot anyone else in the store. After everyone is killed or wounded, I break the displays and take anything I want not fearing someone in the store will shoot me with their CCW. I think this will be the criminal counter tactic to armed citizens and store owners.

This 22 pistol is easily modified.You can remove (grind or snip off) the safety catch that will allow the magazine release to operate with the safety on or off.Also you can bend the magazine spring bar to allow the safety to be disengaged with the clip removed. This also will allow the magazine to pop out very nicely.There are a couple of videos on youtube showing these mods. Choose the one that bends but does not clip the magazine spring bar.This will make the pistol a nice backup piece.

Or a body shot, or a leg. Hell you get hit by a .45 and your sure gonna feel incapacitated. I think that’s why so many P.D.’s are going back to them.

Thank you for the information. I always thought one with the 5 inch barrel would be nice. Someone I know picked up one like new at the Phoenix gun turn in. They paid $100 cash for it.

Heck, I was robbed/shot (and still carry) by a .32cal, back in 1974, and it threw me back 5-6ft. Missed everything and I only spent a night in hospital for observation. Sure glad it wasn’t anything larger.

The owner is not in a protected group. This happened on May 9th, so the time seems ripe to push the media angle that this was a racist frameup.

Perhaps the proper authorities are only waiting for the Zimmerman verdict. You would think that someone would have contacted the Department of Justice (DOJ) Community Relations Service (CRS) by now.

If you posted that on Facebook a SWAT team would have already broken down your door, shot your dog and hauled you off to jail.
