Letter: Do you think criminals will report gun sales?
The Camp Verde Bugle ^ | April 23, 2013 | Rick E. Brenfleck

Editor:

I can't resist the urge to offer a few comments about the letter from A.E. Andress in the Friday edition of The Bugle regarding a "rational and reasonable" approach to guns. I'll address the proposed "modifications" to the Second Amendment by the numbers.

1. Universal, comprehensive background checks. The Tucson shooting, the Aurora shooting, and the Newtown shooting were all reportedly done with weapons that were purchased from licensed gun dealers, hence, the purchasers went through the already federally mandated background checks. Even the guy who shot President Reagan and Mr. Brady, for whom the Brady Bill is erroneously named, reportedly bought his gun legally, months before the attack. How would increased or enhanced background checks have prevented any of these shootings? And how would you enforce it? How would the government know if, for example, I sold one of my guns to a friend? And do you think criminals will report their sales?

2. Banning "assault weapons": Semi-automatic weapons have been around since before the turn of the 20th century, and even anti-gun President Clinton's Justice Department testified in Congress that they are involved in a miniscule percentage of crimes. And, given the number of such guns that are already in private possession, does anyone seriously think passing a law will entice criminals into turning theirs in? And have you read Senator Feinstein's bill? A semi-automatic rifle that would otherwise be legal is an "assault weapon" if it has a pistol grip. How does the shape of the grip make a gun more or less dangerous?

3. Banning "multi-shot cartridges"? Forgive me, but if you're going to comment on something, you really should have at least a rudimentary knowledge of what you're talking about. There is no such thing as a multi-shot cartridge.....

Rick E. Brenfleck is under the mistaken impression that the proposed “modifications” to the 2nd Amendment are intended to stop criminals.

The biggest waste of time you’ll spend is arguing with a liberal about what they claim to want instead of what they actually want.

Liberals ‘ideas’ NEVER work. They’re always based on emotion, never on facts or logic. They just ‘eff things up more.

Their ‘ideas’ on gun control are a good example.

Ban reloading? Ban resale of military brass? We're dealing with a combination of evil and stupid, but they may still have a plan.

True. Criminals don’t want to commit a crime because it would just be wrong.

NO, criminals do not have to report sales or do background checks because...wait for it..the SCOTUS has ruled such actions violate the perp’s Fifth Amendment rights! To do so is self-incrimination; therefore, criminals don't have to report sales or do background checks. However, such minor inconveniences are perfectly acceptable for people who are NOT the problem these laws supposedly fix.

So... if one buys a weapon at the local gang meeting, and doesn't report it, he becomes a criminal, and by becoming a criminal, he's protected from EVER reporting it by his 5th amendment rights. Nice! No one EVER has to report any purchase or have a gackground check.

According to SCOTUS, if you’re a bad guy, for whatever the reason, to report the acquisition of a firearm amounts to self-incrimination, so bad guys don’t have to do so. That’s my read.

Now, let’s apply this to the NYS “SAFE Act”. The act criminalizes sale or possession of unregistered guns. But, if you have a proscribed item, admission of such for the purposes of registration becomes self-incrimination and violates the Fifth Amendment’s protection. [That’s my read, but I am not a lawyer and I don’t play one on TV.]

The Bostoon terrorists didn’t want to go through the paperwork to obtain a gun, and they wanted a high capacity magazine to boot and they wanted it quickly, so they killed the MIT police officer to take his.
This police officer was killed because Massachusetts has a strict gun registration and application process.
