The defendant (human) can use no more force than that equal to the plaintiff (the bear). The bear was unarmed. Thus, the defendant used excessive force on defending himself. Hang em high! /sarc
I don’t know about Massachusetts, after all they elected the kennedys and war hero (sarc) john f’ing kerry, but down here he should demand a jury trial. I don’t think there is any way in hell he’d ever be convicted and the DA that brought the charges would soon be gone!

Friend of my almost went through the same thing. He shot a nuisance bear in the neighborhood. He called the game warden just to let them know and that’s when they threatened him for shooting a bear out of season without a hunting permit. Nothing ever came of it but now he knows better.
Of course. The bear’s life is worth more than a human’s. Especially a man with a gun.

If the law requires you to report killing an animal (of any kind) out of season or without the proper license make sure you do it through a third party such as your attorney. Instruct him to fulfill any obligation required by law but no more. I think in this case it would be 'dead bear, 123 street' and no other details. Refuse to feed the system that is trying to use you as an example. You do,after all, have the right to remain silent and anything you say WILL be used against you.
