Things to watch for during a “Declared National Emergency”

When the Constitution of the United States was framed it placed the exclusive legislative authority in the hands of Congress and with the President. Article I, Section 1 of the United States Constitution is concise in its language:

“All legislative powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.”

That is no longer true. The Bill of Rights protected Americans against loss of freedoms. That is no longer true. The Constitution provided for a balanced separation of powers. That is no longer applicable.

Perhaps it can be summed up succinctly in the words of arch-conservative activist Howard J Ruff:

“Since the enactment of Executive Order 11490, the only thing standing between us and dictatorship is the good character of the President, and the lack of a crisis severe enough that the public would stand still for it.”

Next we will look at all legislation passed or attempted by the dishonest Socialist regardless if they call themselves Progressive, Liberal, Independent, Republican, or Democrat.

If you have a computer you can look up the legislation.

Here are just a few Executive Orders that would suspend the Constitution and the Bill of Rights. These Executive Orders have been on record for nearly 30 years and could be enacted by the stroke of a Presidential pen:

EXECUTIVE ORDER 10990 allows the government to take over all modes of transportation and control of highways and seaports.

EXECUTIVE ORDER 10995 allows the government to seize and control the communication media.

EXECUTIVE ORDER 10997 allows the government to take over all electrical power, gas, petroleum, fuels and minerals.

EXECUTIVE ORDER 10998 allows the government to take over all food resources and farms.

EXECUTIVE ORDER 11000 allows the government to mobilize civilians into work brigades under government supervision.

EXECUTIVE ORDER 11001 allows the government to take over all health, education and welfare functions.

EXECUTIVE ORDER 11002 designates the Postmaster General to operate a national registration of all persons.

EXECUTIVE ORDER 11003 allows the government to take over all airports and aircraft, including commercial aircraft.

EXECUTIVE ORDER 11004 allows the Housing and Finance Authority to relocate communities, build new housing with public funds, designate areas to be abandoned, and establish new locations for populations.

EXECUTIVE ORDER 11005 allows the government to take over railroads, inland waterways and public storage facilities.

EXECUTIVE ORDER 11051 specifies the responsibility of the Office of Emergency Planning and gives authorization to put all Executive Orders into effect in times of increased international tensions and economic or financial crisis.

EXECUTIVE ORDER 11310 grants authority to the Department of Justice to enforce the plans set out in Executive Orders, to institute industrial support, to establish judicial and legislative liaison, to control all aliens, to operate penal and correctional institutions, and to advise and assist the President.

Here are the later Executive Orders:

EXECUTIVE ORDER 11049 assigns emergency preparedness function to federal departments and agencies, consolidating 21 operative Executive Orders issued over a fifteen year period.

EXECUTIVE ORDER 11921 allows the Federal Emergency Preparedness Agency to develop plans to establish control over the mechanisms of production and distribution, of energy sources, wages, salaries, credit and the flow of money in U.S. financial institution in any undefined national emergency. It also provides that when a state of emergency is declared by the President, Congress cannot review the action for six months.

EXECUTIVE ORDER 12148 created the Federal Emergency Management Agency (FEMA) that is to interface with the Department of Defense for civil defense planning and funding. An “emergency czar” was appointed. FEMA has only spent about 6 percent of its budget on national emergencies, the bulk of their funding has been used for the construction of secret underground facilities to assure continuity of government in case of a major emergency, foreign or domestic.

EXECUTIVE ORDER 12656 appointed the National Security Council as the principal body that should consider emergency powers. This allows the government to increase domestic intelligence and surveillance of U.S. citizens and would restrict the freedom of movement within the United States and granted the government the right to isolate large groups of civilians. The National Guard could be federalized to seal all borders and take control of U.S. air space and all ports of entry. Many of the figures in the Iran-Contra scandal were part of this emergency contingent, including Marine Colonel Oliver North.

Barack Obama: Swine flu a national emergency

President Barack Obama declared the fast-spreading swine flu a national emergency Friday night, a move that authorizes federal officials to waive some requirements in dealing with the virus, such as letting hospitals set up separate facilities to keep patients with the virus from infecting others.

The White House announced Saturday that Obama had signed the proclamation, saying it will make it easier for healthcare providers to “handle a surge in H1N1 patients" if necessary.

In a letter sent to Congress reporting the move, Obama wrote, “the rapid increase in illness across the Nation may overburden health care resources and that the temporary waiver of certain standard Federal requirements may be warranted in order to enable U.S. health care facilities to implement emergency operations plans."

Since April, over 1,000 people have died and 20,000 people have been hospitalized by the virus. Thousands more have gotten sick from the flu with the onset of fall, resulting in mass absences from school and work across the country.

CDC officials estimated this week that 1 in 5 children had symptoms of H1N1.

If it’s Sunday, expect to find Obama golfing at Fort Belvoir. This week, though, his foursome includes Melody Barnes, President Obama’s chief domestic policy advisor -- and the first woman who’s played golf with Obama during his 24 trips to the links since taking office.

Barnes, wearing a baseball cap, dark long sleeve shirt and beige pants, joined Obama the same day that the New York Times is running a front page story, Man’s World at White House? No Harm, No Foul, Aides Say, the latest in a round of similarly stories triggered by a high-profile, all-male basketball game the president played in earlier this month.

Deputy Press Secretary Bill Burton initially told pool reporter Lynn Sweet it was “not true” that Barnes was the first woman to golf with Obama, but when the Chicago Sun-Times reporter emailed back to ask who the others were, Burton replied:

“I was wrong about this - all apologies. He golfed with women on the campaign trail but not until Melody this year. Sorry to all the people who were unwittingly misled by what I gave the pooler.” (4:19 p.m.)

Let's take a look at some of these E.O.'s.

10990: Reestablishing the Federal Safety Council (superceded by 11612 (which does something similar)
10995: Assigning telecommunications management functions. Ah, maybe we're on to something. Oops, it was revoked by EO 11556, which was revoked by 12046.
10997: Assigning emergency preparedness functions to the Secretary of the Interior. Revoked by EO 11490.

These are Kennedy-era EOs, and every one I check out was revoked or grossly amended. Plus, they aren't as draconian as outlined above or aren't even close to what the list says they are. The poster says "nearly 30 years" and it's well past 40, almost 50. This leads me to believe this is an old one that has been dragged around for years, still scaring gullible people.

Come on, how long have we been using the Internet? I'm half tempted to send out a scam e-mail saying Executive Order 19223 allows for Congress and the courts to be dissolved in an emergency, leaving the President in power. How many people would buy it and never bother to do a little checking?

maybe, but maybe not...BHO is being squeezed from a lot of directions. When he makes a move, it’s always for several reasons, and usually the reasons are only tangentially related to the the reason stated.

So...taking guesses:
1) while H1N1 is here, it is a convenient reason that can easily be backed up by WHO, CDC, etc
2) while Nat’l Emergency is in effect, he has more control/power at his disposal (like an ace-in-the-hole)
3) $$$ involved - payback to big pharma
4) wonder about it being related to passing ObamaCare but not sure how that might be (unless related to #3)
5) takes the Fox debacle/humiliation right off the “front page”

IMO, it has little to do with the H1Ni flu

1) because he has taken no other corresponding actions commensurate with an epidemic
2) he put out the news over the weekend & doesn’t seem to want to talk about it -— in fact BHO didn’t seem to send out any minions to talk about anything (as one Freeper pointed out about the Sun am lineup)

Yup, there is only ONE PLACE in Section 9 that says Habeus Corpus may be suspended (NOT HAVE TO, but MAY BE) in only TWO Cases: Rebellion or Invasion.

NO OTHER PARTS of the Constitution can be suspended. NOWHERE does it talk about having a SHADOW GOVERNMENT to take over if something happens. NOWHERE does it say that ANYONE has power to suspend the entire Constitution. And it could be argued that what is being talked about in Section 9 are things that have to be done in concert between the President AND the majority of Congress, NOT JUST the President.

PS to previous post. Just reading over the Executive orders and remembered that my first thought when I heard the news about the Nat’l Emergency was the media -— I wondered if the BHO would attempt to use it as a way to control the “bad” media who are exposing him.

CDC is only testing people who are hospitalized for H1N1 in the US. Everyone else is tested for seasonal flu and if positive are assumed to be H1N1 but not tested for H1N1 unless they were hospitalized.

In the US CDC is not collecting H1N1 data on the general population so they lack the base number of infected people to determine accurately, the death rate for the virus. They don’t have a basis in data to determine that the swine flu is “wide spread” because they are not testing for it beyond hospitalizations and deaths. The only valid way to determine if the virus is widespread and dangerous is to test for the flu in selected representatives areas and then they could make valid data assumptions for the Nation.

CBS just reported according to early state by state data of general population tests, only 1-3% (I am recalling here) of those identifed by their doctors as having swine flu based on symptoms and a positive regular flu test, actually tested positive for the swine flu virus. That data was gathered before CDC stopped testing for swine flu in the general population in July.

The data you selected from the CDC site is results from hospitalization testing not general population testing. 37.5% of those hospitalized (4,855) with suspected swine flu
came out positive. However, that is a bogus number because many of those who were attacked by the flu ended up in the hospital after the flu passed with lung damage and/or deadly infections caused by the weakened immune system from the flu. By the time they get to the hospital, they no longer test positive for the flu.
