The is no Constitutional requirement for Obama to "prove" anything whatsoever.

There is a Constitutional requirement that he is a “natural born citizen,” but there is no requirement that he “prove it.”

If someone wanted to challenge his natural born status, that Plaintiff would have to bring civil suit in a federal court (you could try in a state court with aim of denying electors, but it would get bumped to the fed district right away) with a claim that he is not constitutionally qualified, seeking to have him removed from the ballot or office.

It would then be up to that Plaintiff to prove, by a preponderance of the evidence, that Obama was not a natural born citizen, and since USC, 8, 1401 defines any child of a US citizen (such parental US citizen having lived in the US at least 5 years in their lifetime) to be a natural born citizen, then the Plaintiff would have burden of proving that mother was never a US citizen and/or she never lived here more than 5 years in her life.

Like I said, this is a non-starter.

Marriage status does not enter into USC, 8, 1401 in any way.

Mother could be married, divorced, a multiple wife, raped, etc. USC, 8, 1401 cares not.

He is a citizen because she was and she had lived in US more than 5 years in lifetime. E O S.

I gather you believe that the only reason for this thread is to challenge the notion that Bambi meets the natural-born citizen requirement. I dont know where you have been for the last month, but you are mistaken. I have not been a supporter of that argument.

It does appear that Obama is hiding something. The question is what, and why.

I should probably add, however, that others do not agree with you on the test for citizenship based on status of mother (if he was not actually born in HI. I still think he probably was). Numerous people have posted that AT THE TIME the requirement was different, and that she did not meet it because of her young age.

I can’t settle that argument because I have no expertise in the subject.

Thank you for the explanation and reasoning.

My reasoning is thus: If something is required for a position, the candidate must prove that requirement is met. The Constitution requires the President be a natural born citizen. If a Presidential candidate's citizenship is credibly challenged, the candidate must prove his citizenship. This challenge need not be issued in court, though that would be definitive.

Senator Obama’s citizenship has been credibly, publicly challenged. The Senator has not provided proof of his citizenship by either parentage or place-of-birth.

Too many people are assuming Senator Obama was born where he said he was and to the people he claims as parents. I assume nothing. I require proof.

The Senator can easily prove his “natural born” citizenship with a birth certificate showing he meets the Constitutional requirements. He has not done so. And I believe the burden of proof is on the candidate, not We, The People.

Now I do note your kind response to my query did not cite any documents supporting Senator Obama’s parentage, place of birth, or date/time of birth. Until such documents are cited or provided, they do not exist. Therefore my points of contention remain; burden of proof (I believe it is on the candidate), and parentage (Senator Obama has provided no proof of his mother's identity).

And that's the crux of it. So at this point, we should probably agree to disagree.

It looks like Hawaiian officials are stone walling the release of Obama's birth certificate.

Here’s another blogger giving a thumbs down with pics to obama’s birth certificate. The guy says he is a board certified forensic computer investigator. He says his background includes a lot of investigations into forgeries. His work on obama's birth certificate shows a lot detail.

Its reasonable to conclude that the Obama campaign would be hesitant to release his birth certificate because it would show that he was born illegitamate. Since there is a significant percent of the US population that is illegitimate -- you would think that barak would be comfortable releasing his birth certificate. but maybe not.

Jesse Jackson's remarks about wanting to cut off baraks nuts came because of baraks speech that exhorted fathers to take part in their children's lives--especially black fathers.

That speech may have come because of speculation on the internet about baraks birth certificate--which would show that his mom was single when she gave birth.

As well Michelle's remarks that barak's mother was "very single" when barak was born means that barak obama was born "barry dunham".
