Health workers that volunteered to come to NY during pandemic have to pay state income tax: Cuomo

Health care workers that came to New York to help fight the coronavirus pandemic at its epicenter will have to pay state taxes, according to the governor.

He addressed the issues Tuesday at a news conference.

“We’re not in a position to provide any subsidies right now because we have a $13 billion deficit,” Gov. Andrew Cuomo said. “So there’s a lot of good things I’d like to do, and if we get federal funding, we can do, but it would be irresponsible for me to sit here looking at a $13 billion deficit and say I’m gonna spend more money, when I can’t even pay the essential services.”

Even though the state government asked thousands of people to come to New York from out of state to help fight coronavirus, they will have to pay New York state taxes, even on income they might make from their home states that they’re paid while in New York.

Cuomo said he needs help from Washington in order to cover budget deficits from COVID-19, let alone subsidize state income tax for essential workers that flocked to New York’s aid. …

The nurses from Jersey will be ok.

Nothing new.

If you work in New York, but do not live there, you must file a non-resident tax return and report your income earned there. ... So that you are not double taxed, New Jersey will allow a credit for taxes paid to another state. The amount of the credit can include both state and local jurisdiction taxes.

Done all the time to pro athletes. They file everywhere they play or train (if that state has a state income tax).

I work for a company in Massachusetts but live in Georgia. I do not pay any Massachusetts taxes but rather Georgia taxes. In the past I’ve worked for companies that required me to spend an extended amount of time (30-60 days) in another state. My income tax is based on where I am a permanent resident not the location I am working at.
If a company from NY hired me to work in NY for a period of time I would expect to pay NY taxes.

So how are professional athletes the same as health care volunteers who go to another state in the case of an emergency?

not sure I understand the question.

The subject is the legality of a state collecting income taxes from non-residents if they have income for work done there. Might not be wise, but it’s standard practice.

New Yorkers elected Cuomo and pals. As we see, it’s a mistake to help them in any way.

1. Taxing people who work in your state but do not live there is unconstitutional. The fact that it has not been challenged changes nothing.

2. You should have told them that when you asked them to come and help. That you didn’t, constitutes fraud, and you should be jailed.

That’s true. I am a nurse and other nurses were showing me recruitment ads paying as high as $10000 a week, all expenses paid. After what I have read about the working conditions I wonder if many decide it wasn’t worth it.

I'm open to correction, but I believe NY and NYC can only tax income earned in NY or NYC. Not income from your state of legal residence. Needless to say the Governor is disinterested in any of those paid volunteers relocating to NY. Or in raising "volunteers" if needed in the future.
