Class Action Lawsuit Against NFL, Players and Players Union
Just had a phonecon with a partner at my old firm in DC. They are establishing a class of injured plaintiffs who are being denied the enjoyment promised when they bought season tickets to NFL games, their children exposed to anti-Americanism, psychological trauma among vets and family members who lost loved ones in wars,
Defendants will be the League, individual teams, individual players in teams where an identifiable segment of the class of plaintiffs are located, and the players union. Other plaintiffs class will be those who bought season passes to watch games on Cable. Others might be vendors in the stadiums, fan apparel manufacturers, etc.
Compared to some recent class action litigation, this will be easy .and NFL will pay through the nose. I would expect the fees for the plaintiffs lawyers alone will easily run 60 to 150 million dollars. The class will probably get 50 to 70% their season ticket cost as settlement damages.

I wouldn’t have bought tickets. i boycotted last year. My values don’t have a price. if you insult my basic values, the people in my family who were shot in combat, or those who served in the military and you go to NFL games then F—k you!
If I was representing GB, I’s contact P’s attys and agree to get our case kicked, in exchange for testimony as to why GB thought it was wrong to “take a knee.”

And remember, you do not need statutory permission to sue. There does not need to be a violation of any law in order to litigate for damages.

OTOH, it may turn on whether the dem judge is more aligned with the left's broader intent to kill the manly sport of (American) football.

Even if the rule is not clear, a case can still be made for refunds to all fans who are insulted by the people performing for them, committing acts that were not part of the deal.
Any sane judge and most of the other type that seems to be the majority would throw this out.

MRS. I don't think that anger is healthy, but he will have to come to it in his own time."
LAWYER: "Wouldn't it be better for him to do something constructive,other than watching football anyway? Shouldn't he be doing charity work, or exercising, or something else rather than 3 unproductive hours in front of a television?"
MRS. RLMOREL: "I don't see why. He works a very stressful job between 60-70 hours a week with an hour commute on each end, I'm not a golf or fishing widow, he doesn't want a boat or a plane or any other big, expensive toys, he spends enough time doing all kinds of things around the house that need doing. He used to read a lot, and I mean, a LOT, but he doesn't read anymore because his eyes bother him so much, and he talks forlornly all the time about how much he misses reading. Sure, he has other pastimes he likes, so he isn't just some guy watching football all week. It is just when the game on. He tells me he has been watching football avidly since 1971. He doesn't watch any other sports, though he used to play hockey 2 or 3 nights a week years into our marriage...no hockey, baseball, basketball, nothing. The only sport he is interested in is NFL football. He has a few of his buddies over, they scream and yell, the cat runs out of the room. I like football, but he and his buddies love it. I like that he enjoys it, because he works really hard. I don't mind giving him his space to do it! He doesn't ask for much.
LAWYER: "Why is he so angry about this?"
MRS. RLMOREL: "He grew up in a military family, his father was a 30 year veteran spanning WWII to Vietnam, and is buried in Arlington. He served 4 years himself, and is prouder than, as he likes to say, "a dog with two tails" of his and his family's service. He is always talking about how important our symbols are, not for themselves, but for what they represent, and for that reason, he gets angry when he sees someone desecrating a flag or even not paying it proper respect. I always laugh when he tells how, when living on bases as a kid, when they knew colors and taps were about to sound, they would run madly to get under cover so they wouldn't have to face the flag and stand at attention! But when they sounded, they all stopped, stood still, and faced the flag. When I asked if they ever would ignore it, he would say "Oh, no. Never, ever. First, we didn't want to disrespect the flag not because it was a piece of cloth, but because both of my parents raised me and my siblings to know it stood for something. Secondly, it would have been like disrespecting my father, my friends fathers, and every person who ever served. So we all stood still, arms by our sides, no clowning around when the flag went up or down on the base." You see, he is kind of old fashioned about a lot of things. Hi still calls all women 'Ma'am', and men 'Sir'. He holds the door open for women and gives up his seat for them even though they glare at him, and even opens the car door for me sometimes. He wears a suit to Graduations, Wakes, Funerals, and Weddings, no exceptions. Last college graduation he went to for his best friend's son, he said he was the only one in the entire place with a suit. But he won't change. He is a bit of a dinosaur about things like that. He knows it. He just won't change. And it is the same with the flag of our country. When we go to parades, he is sometimes the only one to stand and uncover when it goes by. People look at him strange, but...it's just how he is. When he goes to some sporting thing and they have the national anthem, even though everyone else starts to stamp and cheer long before it ends, he just stands there motionless and won't move. So you see why it is particularly galling to him, these professional athletes who have every convenience and privilege, kneeling down during the national anthem."
LAWYER: "If it bothers him so much, why won't he simply stop watching?"
MRS. RLMOREL: "I think for two reasons: He identifies with the players who stand there and pay true respect to the flag, and, well...he is just stubborn. He is irate that he feels like he is being forced to do something against his will, and he pushes back against that. He is one of those people that has to come to things in his own time, he can't be dragged there by his halter. He sees this as something perpetrated by the left, and he can't stomach the thought of, as he says, "walking away and leaving the field of battle to them". He feels that like so much in society, that is what people like him have done, like someone who says 'fine, you can have what I have' and walks away, and he is tired of it. He feels that we have walked away from so much in society...walked away from right and wrong, from honor and decency, from our veterans, from love of country, and damn it, he isn't going to walk away anymore. So he struggles with it. That is why it is causing him harm. He has walked away from so many things, things he has enjoyed, and I feel like he has drawn a line in the sand for himself.
This thing has morphed. There are some people angry that Trump said what he did, but I agree with Trump.
Those people kneeling ARE "Sons-of-Bitches'. And Trump didn't instigate this. He brought it to a boil, which is fine by me.
What makes it even more galling and irritating is that it isn't even a real issue. If disproportionate killing of black men by white police was a real issue, I still wouldn't want it in my entertainment, but I would still be sympathetic to it.
But it isn't.
It is a racist myth. And the NFL, the NFL Franchises, and the players who are perpetrating this hoax and bringing it onto the NFL field such as Michael Bennett and and Jason McCourty, along with players who are not only too cowardly or cowed to speak up but also participate in the hoax, are to blame for this.

-Sidenote to All, but the claim could be made the people that buy the tickets and sports memorabilia are doing so to support their team, if they find (due to the team’s disregard for America) that they no longer wish to do so maybe they could at least get money back for tickets that haven’t already been used. — I guess I just really want to hit them where it hurts...
And there is the rub. The league rules that The National Anthem must be played prior to every NFL game, and all players must be on the sideline for the National Anthem.
During the National Anthem, players on the field and bench area should stand at attention, face the flag, hold helmets in their left hand, and refrain from talking. The home team should ensure that the American flag is in good condition. It should be pointed out to players and coaches that we continue to be judged by the public in this area of respect for the flag and our country.
Failure to be on the field by the start of the National Anthem may result in discipline, such as fines, suspensions, and/or the forfeiture of draft choice(s) for violations of the above, including first offenses.
Hence, when the season ticket holders purchased their tickets, they had a reasonable expectation that this crap would not be tolerated.
