They have the driver’s statement. They have the position of the house and the squad car. They will have other forensic evidence. Investigator’s face this challenge all the time because people have the right to remain silent. The burden of proof is on the government.
Officer Harrity made a very smart move in talking to the investigators. Strong indication he has nothing to hide and that he is not going to risk he freedom by helping to cover up for the officer who likely murdered the woman.

The partner of a Minneapolis cop who shot dead bride-to-be Justine Damond was ‘stunned’ when the officer opened fire through a squad car door, sources say.
Officer Matthew Harrity, who was in the driving seat, was speaking to Damond after she called 911 to report a sexual assault occurring near her home, when his partner reached across him and fatally shot her in the abdomen.
As a muslim, that cop knows that 27 of his relatives will get to paradise because he killed an infidel. He might have a lot more relatives, better keep an eye on him.

What surprised me most in that info is that both officers were essentially rookies. Noor, at 21 months on the job, had almost double the experience as the other officer. My son is going into LE and I would hope his first partner would have some wisdom and experience!

I provided a reference to the newspaper report claiming three anonymous sources on Damond talking to the driver.
The investigator’s report did not indicate whether any conversation was taking place or not between Damond and the driver when Damond was gunned down.
There was also nothing in the report about whether Damond was or was not carrying any object in her hand that was visible to the driver. nor was there anything in the report on whether the driver heard any warning from his partner before he pulled his gun from his holster and fired at Damond.
Perhaps a later update of the investigator’s report will address those unanswered points.

My guess is that his defense will be that he suffers from PTSD from living in Somalia and something triggered a flashback causing him to panic.

I think it is the residents who should be "fearing for their lives" in Minneapolis.
There is simply no excuse for what happened. Even in a situation where there might be loud noises, or confusion about what is going on, unless you are in an active firefight and your partner is disabled, shooting across your partner is crazy. Shooting an unarmed woman who is talking to your partner is way past crazy.
I was stunned when I read that the other cop was a rookie.
What the hell is the matter with the department allowing such a thing?
The chief is a woman,I’m a woman,but I think that men are more suited for this type of thing.

I believe this report from Minnesota LE put the best possible spin on things for the Officers.
If the driver thought they were being fired on - he would’ve floored the gas.
I think far off fireworks is the cover story.
