The terrifying and terrible prospect of Justice Kennedy retiring

The end of the Supreme Court term looms, and with it the prospect — the terrifying prospect — of a retirement. Specifically, the retirement of Justice Anthony M. Kennedy, who will turn 81 next month and is the longest-serving current justice, named to the high court almost 30 years ago.

So if Kennedy is inclined to retire, it is hard to begrudge him that choice. But his departure would be terrible for the court and terrible for the country. It could not come at a worse time. Any court vacancy these days, under a president of either party, triggers a battle between liberal and conservative forces. Kennedy’s retirement would unleash nomination Armageddon, given the feral political environment and the pivotal role he plays on the closely divided court.

I love seeing the she men of the left collectively soil their panties and it happens at least weekly with President Trump. The Trump presidency is an unending source of joy to me.

Kennedy is the ONLY constitutional liberal on the court. Those other four do what they like.

Exactly. Kennedy actually uses the Constitution, even though he misinterprets it sometimes. Kagan and Sodomizer (sp?) are simply partisan rats doing the bidding of their Kenyan master.

Glad that Kennedy held out this long and didn’t retire during Obama’s term.

Honestly: Two liberal justices retire?

But remember, Bork wanted to disarm the American people. AND he would have been on the court for DC v. Heller. Also, he died the same year. Obama would have nominated a third justice not counting Merrick Garland. Kennedy was a blessing in disguise for gun rights if nothing else.

I voted for Trump for this very reason - I balked at the thought of HRC making Supreme Court appointments. Had Bork been on the court, that wouldn’t have been a concern in the 2016 election. We’d have had a liberal-majority court since 2012.
