When asked about the possibility of Donald Trump assuming the presidency instead, Ginsburg responded, “I don’t want to think about that possibility, but if it should be, then everything is up for grabs.” The justice then acknowledged that the future of the court will be decided by the next president:

“It’s likely that the next president, whoever she will be, will have a few appointments to make,” Ginsburg said with a smile.

This Washington POSt opinion is both a lamentation and a not-so-subtle implied threat to Justice Kennedy.

Excerpt: Justice Kennedy, perhaps it is unfair to pile all this onto your shoulders, but is it really wise to subject an already divided country to even more turbulence?

Any court vacancy these days, under a president of either party, triggers a battle between liberal and conservative forces.

And there's yer trouble. It should merely be a quest for constitutional judges.
