The terrifying and terrible prospect of Justice Kennedy retiring

The end of the Supreme Court term looms, and with it the prospect — the terrifying prospect — of a retirement. Specifically, the retirement of Justice Anthony M. Kennedy, who will turn 81 next month and is the longest-serving current justice, named to the high court almost 30 years ago.

So if Kennedy is inclined to retire, it is hard to begrudge him that choice. But his departure would be terrible for the court and terrible for the country. It could not come at a worse time. Any court vacancy these days, under a president of either party, triggers a battle between liberal and conservative forces. Kennedy’s retirement would unleash nomination Armageddon, given the feral political environment and the pivotal role he plays on the closely divided court.

Ginsburg, like the other three, will say and do anything to get her way. They don’t have a liberal view of the Constitution- they don’t care about it.

Kennedy only does what he can ‘liberally’ justify from the Constitution. I disagree, but he is intellectually honest.

Lots of leftist tried hard to push Ginsburg to retire, to insure a leftist replacement.

She wanted to hang on to insure that her replacement was picked by “the first woman president”.

She messed up. It is called hubris. It must burn her no end.

Reagan had a liberal senate, and had to guess who he could get past them; the Bork fiasco shows his difficulty. Bush was just a God-damned statist airhead. Nice guy; patriot; but DEFINATELY the Forrest Gump of American politics. Except Gump wasn’t so arrogantly scornful of the opinions of conservatives.

It’s interesting to look back now to November, and realize that at least three of these judges probably had plans to retire in 2017 under President Clinton. Now? They have to hope their health stays well enough to make it to 2022....maybe even 2026.
