A high school student who stabbed a fellow pupil in the neck with a pencil can't be expelled under her school district's weapons policy, a Commonwealth Court panel has ruled.
In fact, Judge Patricia A. McCullough wrote in the state court's opinion, every Pennsylvania classroom would be empty if her court agreed with the Pittsburgh Public School District that a sharpened pencil is a prohibited weapon.
The case revolves around what happened between the 10th grader and another student at the Barack Obama International Academy on May 9, 2016.

I too have deep blue mark on the inside of my wrist from when a kid stabbed me with a pencil in grade school back in 1956.
I don't give a crap how much you personally identify with the stupid groper that kept feelin the girl up, NorthMountain - the girl did the right thing.
How about if you refuse to take no when you make sexual advances you earn what you get.
Good for the girl.
I think your could probably manage to make your point without being personally insulting.
(No, I didn't read the full article at first. It's an FR tradition ...)
If you didn't even bother to read any of the articles on this incident, well... YOUR POST WAS STILL INULTING, and you still fully earned my response.
Bullshit. I did not address you personally; I did not reference you at all. It was a comment on the idiotic rules imposed by idiot school administrators. If you chose to take it personally ... that's a personal problem. I suggest that you grow up. Yes, that's a personal insult. You deserve it.
Good day, sir.
Wow, I never woulda thunk it - as an official schoolyard pencil stabbing victim I’m in good company!
You indicated outright that defending yourself physically against a much larger assailant deserves to be treated as Assault.
Damned strait that is personal, as that was my situation much of my life.
Slink off now.
Nobody want to hear you continue to defend the right of some teenage snot to assault smaller student. That was the situation, and there is no way you are going to portray your statement as anything else.
Just go. Find another thread where people agree with you.
To be accurate, inside the class. That same year Mary Lou Diamond kissed me in study hall and i had to write 1,000 times, I will not disrupt study hall. Don’t know what she had to do. We couldn’t go home from boarding school if we didn’t do our punishment. So don’t get punished late in the week. I didn’t volunteer for the kiss. It was a surprise but it gave me bragging rights.
Mine was 1953, so I have seniority. LOL
Dreadful!.
Remind me judge, where is the jugular vein located?
Oh, by gosh...you have two of them? Golly gee.
A bully tormented me for 2 years in school till I got him in the neck with a pencil.
He was shocked that I finally had enough and stabbed him. He was also too embarrassed to admit the nerd got him, so I was never punished. Oh yeah, he also NEVER bugged me again.
Looks familiar lol
My first day of school some black girl -think her name was Veronica or Valeria- stabbed my right thigh with a pencil. The tip broke off and it was in there for a while before it finally came out. Can still see where it was in the right light. The teacher saw her do it and did nothing about it.
Got my revenge a year later on the last day of first grade. She sat in front of me and I took my scissors and lopped off several of her braids. Had my trophies, including the little plastic hair clips, that I kept for years.
Back in 5th grade, I witnessed a female “student” (a large, terminally stupid, cow-like creature who was several years older than the other 5th graders) attempt to stab a teacher with a pencil. I can only assume that she was sent to what was then known as “reform school” (Jamesburg, NJ). I never saw her again.
you desire the judges to make law and declare pencils to be weapons and banned from schools?
Yes - the movie Grosse Pointe Blank - he stabs the guy in the neck with a ball point pen.
