All the lawyer should need to do is hold up a copy of the US Code that gives the President the authority.
The judges on the 9th Circuit don’t care about the law.
They may not like it, but I doubt they want the Executive to tell the Judicial branch to go pound sand if they should rule against the Executive in such a obvious case.
If the 9th is so foolish as to side with Robart, the Supreme Court will not be. They will rule 8-0 in favor of Trump.
