Where Was John McCain Born? (Vanity, need clarification)

The resolution says he was born on base, but I have read a dozen times here that he was born in a hospital in the COUNTRY of Panama.

I believe it is a court prerogative to determine the definition. The senate cannot define it or clarify because none of them were around when the constitutional article was written. That could be better for Cruz because McConnell would hang him out to dry as he is already doing.

They are not called Supreme for no reason... It was the Supremes that found the hidden Constitutional right to kill the unborn... It was the Supremes that divined a right for same sex marriage... from a TEXAS case.. And the people yawn.

Yeah, but what can we do. If Hill gets in, they’ll have 7 or 8 votes before she’s done.

I think Cruz would free his folks (if he doesn’t win big in Cal) and support trump and then trump appoint him to the court. Sorry to side track.

Senate resolutions are just politicians grand-standing.

Notice, by the way, it was Claire McCaskill, D-MO, who introduced the resolution. Do you suppose it might have been intended to provide cover for her friend Senator Zero?

But remember, Senate resolutions don't cut anything except public opinion (maybe).

And the supremes constantly avoid addressing issues. If they had taken any of the several cases about Obama, we wouldn’t have this BS now. I don’t know why congress cannot clarify something that they pass, but none of these senators were around in the l1780s and 90s. It just seems that way.

It is called politics. And we the people are now the dedicated servants of the political ruling class. Nobody is on the side of right any longer... It is not rocket science... Natural born literally means born of two US citizen parents on US soil... It is self serving narcissists who get great highs on making 'law' by setting precedence....

The political parties are responsible for who they put on ballots. Start with them. Then send ol lying Ryan Speaker of the House a post card letting him know we are on to his tricks. Vote and pray.

The actual birthplace of John McCain is in dispute and remains unproven due to John McCain refusing to release his certified copy of his birth certificate to the public. While John McCain is reported to have shown a copy of his birth certificate to one selected reporter, the reporter wrote that John McCain was born at the U.S. Navy Hospital Area, Coco Solo Naval Air Station, Canal Zone, which contradicts the alleged John McCain birth certificate released in the 2008 court documents from the plaintiff, Fred Hollander. Hollander’s purported copy of the John McCain birth certificate reports the birth took place at the Colon Hospital, Colon, R.P. (Republic of Panama). Depending on which alleged birthplace is the actual birthplace, John McCain was born in either the unincorporated U.S. territory of the Canal Zone or the foreign territory of the Republic of Panama. Interestingly, however, neither of those birth locations change the fact John McCain III was born with naturalized U.S. citizenship and not with U.S. natural born citizenship. No person born abroad without diplomatic immunity can be born with any U.S. citizenship other than by automatic naturalization at birth; as observed in various U.S. Supreme Court cases such as: United State v. Wong Kim Ark, 169 U.S. 649, 18 S.Ct. 456, 42 L.Ed. “A person born out of the jurisdiction of the United States can only become a citizen by being naturalized....” A reasonable beginners summary may be found at Wikipedia:

John McCain was born in 1936 at Coco Solo Naval Air Station[94][107][108][109][110][111][112] in the Panama Canal Zone. McCain’s eligibility was not challenged during his 2000 campaign, but it was challenged during his 2008 campaign.

McCain never released his birth certificate to the press or independent fact-checking organizations, but in 2008 did show it to Washington Post reporter Michael Dobbs, who wrote, “[A] senior official of the McCain campaign showed me a copy of [McCain’s] birth certificate issued by the ‘family hospital’ in the Coco Solo submarine base.”[109] A lawsuit filed by Fred Hollander in 2008 alleged McCain was actually born in a civilian hospital in Colón, Panama.[113][114] Dobbs wrote that in his autobiography, Faith of My Fathers, McCain wrote that he was born “in the Canal Zone” at the U.S. Naval Air Station in Coco Solo, which was under the command of his grandfather, John S. McCain Sr. “The senator’s father, John S. McCain Jr., was an executive officer on a submarine, also based in Coco Solo. His mother, Roberta McCain, has said that she has vivid memories of lying in bed listening to raucous celebrations of her son’s birth from the nearby officers’ club. The birth was announced days later in the English-language Panamanian American newspaper.”[115][116][117][118]

The former unincorporated territory of the Panama Canal Zone and its related military facilities were not regarded as United States territory at the time,[119] but 8 U.S.C. § 1403, which became law in 1937, retroactively conferred citizenship on individuals born within the Canal Zone on or after February 26, 1904, and on individuals born in the Republic of Panama on or after that date who had at least one U.S. citizen parent employed by the U.S. government or the Panama Railway Company; 8 U.S.C. § 1403 was cited in Judge William Alsup’s 2008 ruling, described below. A March 2008 paper by former Solicitor General Ted Olson and Harvard Law Professor Laurence H. Tribe opined that McCain was eligible for the Presidency.[120] In April 2008, the U.S. Senate approved a non-binding resolution recognizing McCain’s status as a natural-born citizen.[121] In September 2008, U.S. District Judge William Alsup stated obiter in his ruling that it is “highly probable” that McCain is a natural-born citizen from birth by virtue of 8 U.S.C. § 1401, although he acknowledged the alternative possibility that McCain became a natural-born citizen retroactively, by way of 8 U.S.C. § 1403.[122]

These views have been criticized by Chin, who argues that McCain was at birth a citizen of Panama and was only retroactively declared a born citizen under 8 U.S.C. § 1403, because at the time of his birth and with regard to the Canal Zone the Supreme Court’s Insular Cases overruled the Naturalization Act of 1795, which would otherwise have declared McCain a U.S. citizen immediately at birth.[123] The U.S. State Department’s Foreign Affairs Manual states that children born in the Panama Canal Zone at certain times became U.S. nationals without citizenship.[124] In Rogers v. Bellei, the Supreme Court ruled that children “born abroad of American parents” are not citizens within the citizenship clause of the 14th Amendment but did not elaborate on their natural-born status.[125][126] Similarly, legal scholar Lawrence Solum concluded in an article on the natural born citizen clause that the question of McCain’s eligibility could not be answered with certainty, and that it would depend on the particular approach of “constitutional construction”.[127] The urban legend fact checking website Snopes.com considers McCain’s eligibility “undetermined”.[128]

Arguments over McCain’s eligibility became moot after he lost the United States presidential election in 2008.

Where have you been? The whole reason for threads like this is that they haven't ruled. That the meaning of Natural Born is not officially defined.

Of course, they have let enough precedent elapse that they now have only one reasonable way to rule when and if they ever get around to it. LOL!

The only publicly available John McCain birth certificate states he was born in the Colon Hospital, Colon, R.P. (Republic of Panama). This purported birth certificate was made public by Fred Hollander in his 2008 lawsuit. John McCain claims to have privately revealed his genuine birth certificate to a single news reporter, and this reporter claims the birth certificate listed the birthplace as the U.S. Navy Hospital, Coco Solo Naval Air Station, Canal Zone. So, the actual birthplace of John McCain has never been released to the public, unless the birth certificate supplied by Fred Hollander happens to be a true and accurate copy of John McCain’s real birth certificate. If so, then John McCain was born in Panama and not inside the unincorporated territory of the U.S. Canal Zone. If John McCain was born at the U.S. Navy Hospital, Coco Solo Naval Air Station, Canal Zone; John McCain will still have been born outside the jurisdiction of the United States required to qualify for natural born citizenship. Instead, John McCain acquired U.S. citizenship by automatic naturalization at birth under the authority of U.S. Immigration and Naturalization Acts.

This was a 'generic' description on who makes decisions... there was nothing noted about which decision.

The Supremes, Constitutionally can only rule if an individual meets or does not meet, the qualification of 'natural born' US citizen... They have no Constitutional authority to give or take 'natural born' US citizenship. 'Natural born' US citizenship, precedence was set by the Founders. I have NO faith the Supremes follow the 'original intent' of the Constitution.

I seem to recall that the consensus of the amateur sleuths on FR is that McCain is NBC because he had TWO U.S. citizen parents, regardless of where he was born.

The White House website says that Soetoro was a British Subject at birth.

On numerous occasions, for example:

Dred Scott v. Sandford, 60 U.S. 393 (1857). “DANIEL, J., Separate Opinion. Mr. Justice DANIEL. . . . . [quoting Vattel] The citizens are the members of the civil society, bound to this society by certain duties, and subject to its authority; they equally participate in its advantages. The natives or natural-born citizens are those born in the country of parents who are citizens.”

United State v. Wong Kim Ark, 169 U.S. 649, 18 S.Ct. 456, 42 L.Ed. “A person born out of the jurisdiction of the United States can only become a citizen by being naturalized....”

Natural born citizen is a legal term of art that the Congress has no power to define, according to Laurence Tribe and according to the Constitution and its limitations to the enumerated powers of Congress.
