Margo Seibert, Jennifer Moore, Catherine O'Neil, Natalie Brasington, and Taja-Nia Henderson, filed a lawsuit Thursday against New York's tax department and its commissioner, Jerry Boone.
Their demand: Stop imposing a 4% "luxury tax" on feminine hygiene products.
The complaint points to guidelines published by the taxation department in 1998 and 2014 that categorize pads and tampons as "general merchandise." That means they're not eligible for a "medical supplies" tax exemption.

I’ll tell you one thing, ask any woman, none of us consider the monthly cycle a “luxury” in any way, shape or form, lol. None of us.
These women will sue and if you become part of the class action lawsuit you'll get your $2 check in the mail in a few years.
NY will stop taxing these items but tax others to make up the difference. They love to tax and won't go without.
So as a taxpaying NYer I will have paid this tax, will pay the new tax on other items, pay for NY’s attorney's and damages, and get a $2 check. But damn my box of tampons will be 16 cents less!

I think I saw this on an episode of 2 Broke Girls when their boss raised the price of the tampon machine in the ladies room. It did not go well for him.
This is the kind of tax that starts a war among normally compliant sheep. About 25 years ago, Jim “Flim-Flam” Florio and the Democrats imposed a tax on toilet paper. Republicans immediately got a 3/4’s veto-proof majority in the next election. They did nothing. The Dems got it back again in short order.
