If a law is clearly unConstitutional, you SHOULD not obey it. You are not obliged to obey an unconstitutional statute or edict of a court, no matter what the judge says. However, you may wind up paying the penalty or spending time in jail. This is the trappings of Tyranny and the small little steps of oppression creeping into our society.

As someone suggested, if the state just got out of the marriage license business, there would be nothing to give out. Otherwise, ignore federal law at your own peril, as many have done in the past.

The judge denied her, her first amendment rights.
The law is clear and the judge is in the wrong.
Unfortunately she is being railroaded by a misguided judge.

The Supreme Court decides if a ‘law’ is a ‘law’ but can’t make a law unless voted upon by the citizens...have we done that? Has there ever been a vote on this as a nation or has there ever been a vote by each state?

Judges have civil immunity for their actions as judges, so suing the judge will accomplish nothing.

I don’t understand why the judgey guy got his Depends all in a wad. Contempt of the “courts” is quite common in America these days. The “courts” are way out of control. The judgeys are ordering criminals to be released to make room for innocent people.
The thing that everyone is missing here is that the homosexuals could have gone to just about any other county in Kentucky to get that license but no they chose to take her on because she said she would stand by her convictions. Typical liberal gay stance, “ I am going to force you to do it my way. I have all the rights and unless you accept my beliefs you are a bigot.” If I was dying to be married, I would have run to any county to get a license. I wouldn’t be fighting with a clerk I knew wasn’t going to issue me a license. Mrs Davis was not keeping them from being married, they made that choice.
Nope, no law was broke. The Supreme Court issues rulings. It’s then incumbent upon congress to pass laws comporting to those rulings. But congress is too chicken and it’s too politically dangerous to actually do their jobs. So she’s abiding by the only law she can recognize..those on the books for her county.

My guess is this is the type of judicial system actions we will see under the now United States of LGBT, they only adhere to a constitution with one article: BOHICA.

15 years ago, gay marriage was an absurd joke. It still is, but now it’s law.
I have nothing but contempt for the federal government now.
So if I understand the SCOTUS ruling, the laws that make marriage only between a man and a woman are unconstitutional. Ok, we don’t agree with the ruling but nothing in their ruling changes the Kentucky law as it stands on the books.
This clerk has decided to not issue any license (including heterosexual marriages). That seems like a reasonable approach considering there is no valid marriage law on the books in Kentucky.
The court did not rewrite each state’s marriage law but they have invalidated ones that specify traditional marriage.
