The Reason You Haven’t Heard More About The 177 Bikers Arrested In Waco

Whatever happened to all those Waco bikers? You know, the 177 people arrested at the Twin Peaks restaurant in Waco, Texas after a motorcycle rally on May 17 ended with nine people shot dead?

Immediately following the shooting, I wrote about just how badly Waco authorities screwed up the arrests. Rather than trifle with technicalities like the rules for bail under the Texas Code of Criminal Procedure, Justice of the Peace Pete Peterson set bail at a staggering $1 million for each of the arrestees in order to “send a message.” Then I described how prosecuting nearly 200 bikers was crushing the criminal justice system in McLennan County and costing taxpayers a fortune.

Why did the story fade from public attention? What’s come out since the story broke?

As it turns out, it’s no accident that you haven’t heard more about the Waco biker debacle.

First, let’s look at two developments that seem like they would be informative, but actually aren’t.

Police officers witnessing the commission of a crime is probable cause in every court in the country.

“There are posts on this board right now that are enough “probable cause” to allow a zealousDA to charge hate crime. Hear me now; remember me later.”

If that is supposed to worry me, it doesn’t. I don’t even think you know how “hate crime” legislation actually works.

Cops typically stake out the exits and pull over suspicious bikers. Amazing how many are caught with meth on a toy run!

Lots of people on these threads say “I heard this” and “I heard that”, but I’ve found when you press them to produce a source, they never seem to be able to, so I don’t put any stock in that kind of thing. The sources that we do have all seem to say otherwise.

That might well be so, however, does that mean the cops are not justified in stopping any criminals if they don’t stop all of them? I don’t like “selective enforcement” one bit, but I would much rather have police enforcing the law at least most of the time than not enforcing it at all.

Affidavits were based on hearsay

Jackson called Waco police Detective Manuel Chavez as a witness to describe how the affidavits were drafted. To obtain the arrest warrants, Chavez swore before a judge as to their content. He testified Thursday that the document was written by prosecutors in the McLennan County District Attorney’s Office on the day of the shootout.

It is an issue but it was dealt with. Most got out on lowered bonds. When you have such a deadly display in public it takes time to sort out.

Besides, that amount has been given in Waco previously.

In a few cases that have come before judges, the state was asked if it had any evidence of conspiracy. The state's answer was "no." The judge found probable cause for conspiracy anyway.

The affidivit is deficient for crimes of commission.

What I have denied is only statements you falsely tried to attribute to me which I never actually made.

Anyway, I don’t have any hope you will be able to comprehend that distinction, or you would have grasped it already, so it’s pointless to discuss any further. Shouldn’t be thread jumping anyway, that’s against the forum rules.
