The neighbor is too nosy to make a tape and show it to police. I agree he was likely peeing, not masturbating. And, if he was very close to the bush, the neighbor would have to be watching closely to determine what he was doing.
The guy is 81 and could have dementia and not aware he should not be doing that in his yard. However, it was his yard and not some public place like the sidewalk or in front of a building, or in a building. Give the guy a break, just tell him not to do that outside.
