Are they willing to pay for damages without going to court? If yes, I wouldn’t sue. If not, I would.

No, you shouldn't sue.

(Bet you didn't expect THAT one, right?)

In today’s America it is your obligation. Surely the auto manufacturer has committed negligence and endangered you and your family. So has the jurisdiction in which you reside for not protecting homes from roadway traffic. Then there is liability on the part of the last person who tightened the lug nuts, balanced the wheel etc.

Ask your lawyer. At this point (for me), it's about being made whole and getting expenses paid.

Your lawyer will know if it is worth it.

with some damage

******************

What is some damage? $100, 1,000, 10,000 or up?
If they pay for the repairs etc. then why would you sue?

No. Call your insurance agent (homeowners) and let them duke it out.

Why would your first thought be to sue? Did you talk to the vehicle owner first? Were they insured? Did you file a claim with their insurance company?

If all the answers were ‘yes,’ then I guess it depends on how severe the damage was and whether it’s worth the anguish you’ll likely go through while in the courts.

If there's property damage, the insured vehicle's policy holder is liable. I wouldn't think there's any need to sue unless the insurance company balks at paying.

It's the car's owner who is ultimately liable, even if he is insured.

You may be able to get the damage repaired under your homeowner's policy, then let your insurance company fight it out with the car owner's.

It seems like lawyer fees would eat up any potential gains. I would go homeowner’s insurance route most likely.

The good life avoids lawyers for personal remedies except in the most extreme cases.

The tire companies. I've been wanting a piece of them for a long time.

Sue everyone. Sue the lug nut manufacturer for not putting ä warning label. Sue the hub manufacturer because it was too heavy. Sue the tire manufacturer for the pain and suffering caused by a skid mark on the house. Especially sue the driver for negligence. Your pain and emotional trauma will require a life time of therapy and you will never be able to work again. Go full ghetto lotto mode. I suggest you call John Edwards.

“So, if a wheel comes off a passing car and hits my house with some damage but no injuries, should I still sue?”

Excellent Question!!!

Unfortunately, we need more info:

1. Was the wheel that struck your home a Christian Wheel? If so, sue.

2. Was the primary motivation of the driver driven by hate? If so, this is a hate crime and you should sue and press charges - assuming you are not white.

3. Was the driver of the automobile a person of color and are you white? If so, it is your fault. I’m sorry to tell you this, but you are *only* in that house as a result of “white privilege.” You will not have a successful lawsuit.

4. Are you gay? If so, you can sue.

5. Are you a person of any color other than white? If so, you can sue.

6. What color was the wheel?

7. What country was the wheel manufactured in?

All these pieces of information are necessary to answer your question.

Why sue?? Your only supporting bottom feeding lawyers. Work it out with the tire owner or your insurance company no need to sue.
