New Mexico Abolishes Civil Asset Forfeiture

Every year, law enforcement agencies seize millions of dollars simply by suspecting the property is connected to criminal activity. Friday, April 10, after being unanimously passed through the legislature, HB 560 was signed into law by New Mexico Governor Susana Martinez. Read her Executive Message here. Among other improvements, HB 560 reforms the current law on forfeiture procedures by requiring a criminal conviction for seizure and proper reporting.

Civil asset forfeiture is a practice in which assets suspected of being associated with crime may be seized and subsequently forfeited, often without the owner being charged with a crime. Law enforcement agencies are then entitled to keep most of the assets seized. These counterproductive incentives in the laws distort public safety priorities and infringe upon individual liberty and property rights.

A good idea. Asset forfeiture is an open invitation to fraud and oppression. I have no objection to asset forfeiture if the police agency proves beyond reasonable doubt that the item of property was used in or resulted from the commission of a crime.

I remember telling a couple of Texas legislators to do this during the campaign by email. Every state needs to do this.

We should get someone here with legal knowledge to put together a petition and send it to governor Abbot-I’d be happy to turn my neighbors, employer, and friends on to it-people out here don’t want gov fingers in anything that is private business, for any reason...

There has got to be some way that Strauss can be made to STFU and go away-I don’t even understand why he is still in that position-no one I know even thinks the guy is playing with a full deck, much less that he is competent...

Hard to believe that unholy alliance is so strong in state politics-I’ve not met anyone who isn’t a rabid anti-rino here, but maybe it is different in the cities.

It is the question that needs answered. And then that person that can primary Strauss needs support on the ground. And $$s.

I ran the Boot Dewhurst ping list here on FR, but someone else will need to run the Boot Strauss ping list on FR.
