Bowe Bergdahl charged with desertion, Could face life in prison but unlikely

The Army has charged Bowe Bergdahl with desertion and has referred to an Article 32 military preliminary hearing which is the military version of a grand jury. Their job is to determine whether the charges against Bergdahl are sufficient for a court-martial trial or whether they should be dropped altogether. The court proceedings will be held at joint base San Antonio-Fort Sam Houston, Texas.

The charges filed against Bergdahl under The Uniform Code of Military Justice are articles 85 and 99.

Article 85 – Desertion.

Definition:

Any member of the armed forces who, without authority, goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently; quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service.

Article 99 – Misbehavior before the enemy

Any member of the armed forces who before or in the presence of the enemy—runs away; shamefully abandons, surrenders, or delivers up any command, unit, place, or military property which it is his duty to defend; through disobedience, neglect, or intentional misconduct endangers the safety of any such command, unit, place, or military property; casts away his arms or ammunition; is guilty of cowardly conduct.

Bowe Bergdahl is accused of abandoning his post in Afghanistan in 2009 by leaving his unit in a warzone. He is being charged with desertion for leaving his weapon and ammunition behind and endangering his fellow service members. That fellow soldiers were killed justified the misbehavior before the enemy charge. The combination of charges could lead to a lifetime sentence and a bad conduct discharge. The charges were authorized by Gen. Mark A. Milley, the commanding general of U.S. Army Forces Command.

Whatever happened to being executed for deserting your post, in war time, in a war zone? I don’t get it. The military has become a bastion of political suck ups at the top, allowing for division and conquer by the elitist, leftist creeps in the White House during this administration and the boy clinton administration. Thanks to the media, that’s all they hype on is the perverts, queers and whack jobs that manage to stay in the military and make the other 99% look bad. Deliver us Oh Lord from this madness. The rest of the world must truly laugh at us. Pray for the families who lost loved ones searching for bergdahl to “rescue” him from the enemy. They are the ones who deserve sympathy and compensation, not this traitor. We are living in the Twilight Zone with two years to go, unless he declares himself emperor.

He should not get life in prison.

He should be executed immediately. They should have held a field court-martial the moment they got their hands on him and had a summary execution on the spot.

What did President Obama know and when did he know it? Returning Al Qaeda officers to the battlefield for a known deserter/traitor was an act of treason.

I say impeach him after he leaves office. strip him of his legacy, strip him of his 10 years of post-office checks.

It wouldn’t be accomplished in the time remaining before he leaves office. He just ran out the clock on Bergdahl with 10 months of delay. He knew the score long before this.

Most comments I’ve heard from those closest to him indicate he didn’t just desert his post, but he chose to commit treason by seeking out the enemy to join their cause.

Good discipline of he service would have demanded immediate court martial upon his return, rather than promoting distrust of seniors in the chain of command.

Guilty or not, the court martial preserves justice rather than attacking the defendant’s character.

If a judge sets his sentence he might get less. A jury panel almost certainly full of WOT vets won't go so easy on him.

I sat on a Court Martial of an NCO who was technically guilty but we chose "nullification" and he was acquitted.

The military judge was PISSED and gave our foreman (LTC) hell but nothing he could do about it.

Just saying it would be much easier for the Marxist, Mooslim, Kenyan, Steaming Pant Load Sissy Boy to influence one vs many....

Barack Obama and Bowe Bergdahl share the same worldview.

Obama’s foreign policy should be called the “Bergdahl/Obama doctrine”.

The symmetry between Bergdahl’s and Obama’s desertions is instructive.

Odumbo will most likely pardon him anyway to save face for having made such a BAD swap deal and hosting that huge photo-op spectacle when the Bergdahl’s were paraded all over the WH.
