Police Officer: 'if you don’t want to get shot...just do what I tell you.'
Reason.com ^ | 08/19/2014 | J.D. Tuccille

"If you don't want to get shot, tased, pepper-sprayed, struck with a baton or thrown to the ground," warns Officer Sunil Dutta of the Los Angeles Police Department, "just do what I tell you."

The thing is, Officer Dutta (pictured) is also an Adjunct Professor of Homeland Security and Criminal Justice at Colorado Technical University. And he uttered those words not in the heat of the moment, but in an opinion piece in the Washington Post responding to widespread criticism of police attitudes and tactics currently on display in Ferguson, Missouri, but increasingly common nationwide.

Dutta continues:

Don't argue with me, don't call me names, don't tell me that I can't stop you, don't say I'm a racist pig, don't threaten that you'll sue me and take away my badge. Don't scream at me that you pay my salary, and don't even think of aggressively walking towards me. Most field stops are complete in minutes. How difficult is it to cooperate for that long?

Dutta actually comes off as a reasonable law enforcement officer...He endorses the use of body cameras and dashcams to record interactions between police and the public. He counsels, "you don't have to submit to an illegal stop or search. You can refuse consent to search your car or home if there's no warrant."

And yet he demands unresisting submission to police without argument or even legal protest. Just how do you "refuse consent to search your car or home" without running afoul of the no-nos Dutta warns may get you "shot, tased, pepper-sprayed, struck with a baton or thrown to the ground"?

Remember, this is a thoughtful police officer, with a PhD., who teaches criminal justice.

You say "I do not consent to a search". Why does that require you to insult or threaten the cop?

I’ve been involved in one police stop in my life.My sister was driving (her car) and her teenage son (a big kid) and I were her passengers. It was Virginia,I-95,broad daylight.I remember reminding my nephew several times as we were slowing down and pulling over...”stay still, stay calm, say nothing unless the cop specifically addresses you, keep your hands in sight at all times”.The stop was fine...state trooper, black, very polite and business-like (as was my sister)...we were on our way in less than 10 minutes. And she was couple of hundred dollars poorer.

To: rights with responsibilities
Americans to both our great credit and frequent frustration just don’t like being told what to do. If it’s a policeman telling us to do as we are told....it’s our choice as to the consequences

Actually, that street runs both ways if the police are doing anything illegal.

So, why isn’t this reasonable advice?

1. Record the interaction. If you aren’t ready to record in your car, that’s your fault.

2. Refuse to consent to unconstitutional searches. Men have fought and died for your rights, don’t consent to give them away. Do it respectfully. You’d be surprised how many of the police RESPECT those who know and exercise their rights.

3. If the officer asks you under threat of physical harm to comply with an order that you believe is illegal, state your protest and COMPLY. You have it recorded. If you don’t get your day in court, you’ll probably get a week on Youtube.

4. Have a lawyer. I can “Okay Google” call with my hands tied up wherever.

If you are talking about a SWAT raid on the wrong house, I’d be in big trouble. Somebody strange busts into my house, it won’t end well for anybody. That said, that’s a pretty unlikely scenario.

I think this guy is talking about day to day interactions. Sure, he should be talking about how POLICE should respect those they are supposed to protect and serve, but I got it. We’re like the taxpayer vs. the IRS now. They don’t want to protect or serve. I’ll continue to vote them out, but I won’t poke them in the eye and expect a hug in return either.

I wouldn’t think saying “I do not consent to a search” is insulting or threatening, but I’m afraid that some cops take it that way.

Let's make that rule work both ways. Go perform a physically impossible feat on yourself, or I'll shoot, tase, pepperspray, or beat you to the ground.

Yeah, but if he asks you for ID, just tell him, "It's at yo momma's house." You'll get invited to the White House.

It’s not DIFFICULT to have your rights violated by thugs in uniform.

It’s simple, just SLAVERY.

"How difficult is it to cooperate"

If they would merely cooperate, all this would be unnecessary.

And some people are just wise asses who are looking for a confrontation with the cops. You’re not going to win a legal argument with the cops in the field. Save it for the courtroom.

Nope. You are not authorized to deal death, if required in such a circumstance. He is, right or not. What happens when everybody gets the idea they can actively disobey a direct order from the sworn LEO any time they want?

According to the Bible (Romans 13) he is the one God recommends you to hear and obey. He's the one bearing the sword. If you want him to respect you as a law-abiding citizen, you'd better respect him and his office.

‘What part of “curfew” and “disperse” is not understood?’

the part that conflicts with my right to assemble.

He can KMA. His type is far more of a threat to the republic than mere rioters.

If I have to “disperse” and/or “obey curfew”, it’s *ONLY* because i am not well armed enough. This time.

I understand it perfectly well; and I say “nuts”.

I have been stopped before.

I have found that if you decide to bow up and show the officer what an accomplished sea lawyer you are and how important you are, the officer may choose to show you how impressed with your credentials he really is.

Never upset someone who is in a position of authority. They have the ability to make your life miserable.
If there is a problem, maintain your cool and when it is over, get an attorney.

One thing I have found over my nearly 70 years is that the more guilty a person is, the more they show their backside.

It is better to be quiet and thought a fool, than to speak and remove all doubt.

This isn’t the way it was not that long ago. This is what happened to police after swat hit every unit in the country.
I hope they know enough to keep Sunil off details like the county fair or high school football games. He is a lawsuit waiting to happen.
What an attitude. If I was his boss and read this I would pull his badge, get him a chill pill and some counseling

This aint nothing new. I got the hell beat out of me by the LAPD 40 years ago. I was drunk and ready for a fight. It’s different with cops nowadays. I don’t give them a hard time. Lots of cops have PTSD and are uptight and jumpy. Always keep it cool. Lower the stress level.
Cops have nothing to do with any of the political BS we are all upset about.
