*Vanity* Need a law prohibiting extension of voting beyond election day. No matter what.

As Sandy hits the east coast, I am sure we will wonder what if we were approaching Election Day this Tuesday?

Is there a law , or must there be a law not permitting voting beyond the national election day, no matter what? Regardless of

Massive snow storm in the Plains, Mountains, Alaska. Volcano eruption in Hawaii

Earthquake in California, Missouri, Virginia

East Coast blackout, etc.

One point I must add, if Tuesday were Election Day, then on Monday many poll workers would be required to pick up election materials. Could not have an election with voting machines without them. What happens if you arrive at the polling place & there are no workers?

I’d rather the elections be held just before tax day in April. There is a reason there is a 6 month difference.

The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.

Congress can change the date of the election if they fear a storm is coming, but the entire nation must vote on the SAME DAY (and only one "day") across the country.

The phrase "which Day shall be the same throughout the United States" refers to the "Day on which they [the Electors, e.g., the Electoral College] shall give their votes." So, the Electoral College electors in each state must vote on the same date; the clause does not, strictly speaking, require election day (e.g., the "Time of chusing the electors") to occur on the same day nationwide.

And, as a follow-up, between 1792 and 1845, states were permitted to hold their Presidential elections any time in the 34 day period before the day on which the Electoral College was to vote. Nothing in the Constitution would prevent Congress from authorizing a later election date for Virginia and any other states affected by the hurricane.

Alas, the biggest difference between then and now is instantaneous communication. Any delay in a state would make it a vote factory, because they would know what they need to win. Assuming it's not a Mondale blowout.

Jet...I would normally agree but these days far too many folks do not pay tax and depend on that government check. I think a more appropriate time would be between Thanksgiving and Christmas when people are wanting more cash for the toys.

“I’d much rather see a law prohibiting voting PRIOR to election day (with the exception of traditional absentee voting). This early voting nonsense is ridiculous and an open invitation for cheating, election fraud, and manipulation of public opinion. It’s the worst idea next to election fraud itself.

It’s called Election Day for a reason.”

AMEN!

Great post, great question. As much as I despise early voting, late voting should not be allowed PERIOD. Early voting, mail voting et cetera, lends itself to fraud. Late voting would trump all of those. Provisional voting is a good example. Provisional votes are not counted until days after the election and are used to stuff the ballot box (Minnesota for Franken) and are bullsh*t. If you can’t vote on election day, tough cookies. The system is broken and the people are broken that accept this

There are tornadoes in July, there are earthquakes year round. There are all sorts of problems, TS. Life is a bummer and then you die. The only change I’d like to see is, one day to vote, make it Saturday, and everyone is off work that day at least long enough to go to vote

I agree. Fits right in with the dims old addage “vote early, vote often” I vote early in case I die before election day, don’t want to vote dim poshumously

I thought we were special then.

You were special then as are our troops today. Do you know if your vote was actually counted? Our troops overseas and at home will both be under-represented again this year thanks to the dims in nearly every state putting obstacles in their path. It burns my a** every time I think about it

I’d really rather vote in July. No real reason I can’t walk the 150 yards to the polling place in November, I just don’t wanna.

For that matter, if we can have early voting, why not also allow, late voting. People might be busy doing other things, and they could have forgotten when election day was, or, their transportation broke down on the day of the election, or they, or somebody int he family got sick that day.

In fact, why not have voting every day of the year, every year, and we could then have a "dynamic presidency", where the number of votes, on a daily basis, are tallied, and whichever political party is ahead at any moment, gets to choose some leader within their party to be president, until the next tally of the votes is taken. ;)

I think submitting potential politicians to psych evaluations and what not would be a good idea too.

A pre-employment drug test (required of anyone applying for a government contractor or sub-contractor job)for all elected officials. Random drug tests afterward

Yes, drug tests for politicians should be a requirement as well.

Pretty much every job I’ve ever applied for—in public or private sector—required me to take one; I consider this an irrational and invasive employment screening for most kinds of jobs.

However, politicians are entrusted with immense responsibilities and their judgment has profound effects on the well-being of millions, so screenings would be more than appropriate in their case.

Obama would issue an executive order or get John Roberts to declare that the voting shall continue and the Constitution will not stand in his way.

and that would be a reason to oppose popular vote rather than Electoral College.

“Steve Israel Proposes Electoral College Constitutional Amendment To Boost Popular Vote .” Win 29 extra EV to popular vote winner.

Like all good ideas - there is a flip side. What if it was hitting down South and much of Mississippi and Alabama couldn’t vote? Could allow the more northern (more liberal) areas to swing the States.
