Kamala Harris Eligibility: New Documents Obtained Regarding Status of the Parents of Kamala Harris When Kamala was Born in 1964. Kamala May Not be Even a Basic U.S. Citizen At All.

(Sep. 19, 2020) — On Friday night the Twitter account @kamalakancel posted images of what it said were four documents appearing to show the immigration history of Shayamala Gopalan Harris, the mother of Democratic vice-presidential candidate and U.S. Senator Kamala D. Harris.

To date, Kamala Harris has not responded to questions about her parents’ citizenship status when she was born in Oakland, CA on October 20, 1964 and, more broadly, whether or not she qualifies to serve as a “natural born Citizen.”

Some interpret the Article II, Section 1, clause 5 requirement for the president and commander-in-chief to signify a person born in the United States without respect to his parents’ citizenship, while others point to the different standard for the nation’s chief executive as opposed to that of “a Citizen” for U.S. senators and representatives set forth in Article I.

While the Constitution is silent on vice-presidential qualifications, the 12th Amendment, ratified June 15, 1804, states in its conclusion:

Why they threw Harris into the race is a mystery. She’s not well-liked......even by her own party.

She abandoned her presidency effort early on....... she was getting only 5% of Democrat support.

Her appalling lack of gravitas is a huge turnoff.......she prefers to giggle her way through serious issues.

‘Natural’ means that nobody but parents can bequeath. NO function of any part of government can give or take ‘natural born’ US citizenship ... The founding fathers ... ‘we the people’ are government .... IF her parents were not US citizens, they have absolutely NO power or authority to bequeath to their child ‘natural born’... US citizenship . She is at best an anchor baby... IF that.

I know, I was taught long before the many decided they would pervert the US Constitution ... how I know ... My two US citizen parents, birthed me in Germany ... I have NO US state birth certificate ... I have a State Department document giving me citizenship, signed (auto penned ) by Dean Rusk.

Obama promised he would be more relevant out of office than in office.

A person born in the UnitedStates, for example one born to a foreign diplomat assigned here, is NOT a natural born citizen.

Sorry, but Ted Cruz (with the backing of a lot of conservatives) made Natural Born Citizen a meaningless concept. Just another in a long list of reasons why I intensely dislike my Senator.

I voted for him but I know he is a liar and a cheat.

How can you be so simple minded? Jurisdiction refers to citizenship, which is in the citizenship amendment for former slaves. The writers of that amendment stated that it was for former slaves.

When the 14th Amendment was written the term “jurisdiction” referred to “citizenship” or “subject status.” Thus, if a parent was a legal citizen of another country, or a subject of another country, that would imply that that person fell under the jurisdiction of that other country. That has always been the weakness of the “anchor baby” argument.

You are incorrect.

There is no requirement or definition for a natural born citizen in the Constitution. No rule requiring location of birth, no rule requiring parentage. In Fact, the Constitution SPECIFICALLY ENUMERATES that it is Congress that shall define ALL rules regarding naturalization. That includes the rules for those who are citizens at birth and do not need to be naturalized, i.e. natural born citizens.

And in response to that Constitutional requirement, The First Congress took up and passed laws regarding citizenship and even mentions those that are natural born. From those very first acts of Congress, and subsequently modified many times, the rules for who needs to be naturalized and who does not, have been passed into law by Congress. Under the laws and SCOTUS interpretation of the Constitution and Amendments, the current precedent is to award citizenship to anyone born on US soil or to at least one US citizen parent even while abroad, they are a natural born citizen from the moment of their birth because they do not require naturalization.

Some may not agree with this precedent and may wish to change the rules going forward. This would require only a simple passage of law in Congress and signed off by the President per normal procedure. However, trying to go back in time and creating an ex-post facto ruling that benefits a particular world view is in my opinion a very dangerous precedent. It also seems to be a fruitless effort without the aforementioned changes to law.
