Hillary-Supporting Civics Teacher to Beto: How Will You Skirt SCOTUS on Mandatory Buybacks?

In a new NPR series called "Off the Script," 55-year-old social students and civics teacher Ruben Sandoval, who voted for Hillary Clinton in 2016, asked Beto O'Rourke how he would circumvent the Supreme Court to achieve his mandatory buyback of AR-15s. Specifically, Sandoval referenced two landmark cases that protect the Second Amendment and an American's right to keep and bear arms for self-defense.

"As you know, one of the courses that I teach, I teach Texas government and also state and local government bath at Coronado and EPCC [El Paso Community College]. So we kind of discuss these issues as far as the Second Amendment and the limits on the Second Amendment. And I remember what you said on the stage as far as the buyback program, the mandatory buyback. The question I have is: How would you get around the Supreme Court rulings?" Sandoval asked.

"I mean, you've got the D.C. v. Heller, which began to federalize or actually applied it to D.C., the Second Amendment, and then you have the McDonald v. Chicago, which basically said the Second Amendment is incorporated to all States," Sandoval explained. "And so it would seem as though the courts would probably rule against something banning the AK-47, the AR-15s. And a mandatory buyback program would seem to be deemed unconstitutional, and as late as 2016, the Fourth Circuit Court of Appeals also included assault rifles to be part of the arms that are protected by the Second Amendment. So how would you be able to get around that?"

Trouble is, SCOTUS has declined to hear appeals of Assault Weapon Bans in Maryland and Illinois, so we don't really know if the Supreme Court would strike down an AR and AK ban.

Ah Beeto - what would you know about “weapons of war”? It seems that Beeto (who names anyone after a root vegetable?) never graced a uniform in his inauspicious life and the closest he has been to war was maybe watching MASH reruns.

So, after translation from LyingSackEse, he means "We can pass whatever we damn well please if we have the votes. If it makes it to SCOTUS in 10 years and I haven't replaced two or three justices, we'll pull out Roberts' blackmail material. If even that fails, we'll just have press conferences trying not to cry about the carnage, and use it for a campaign issue, while continuing to pass more laws that wouldn't pass muster with the ruling."

It’s only a ‘buyback’ if the government sold you the gun in the first place and now wants to buy it back.

If they didn’t sell it AND they take it - it’s nothing but common confiscation...

Beto O’Rourke is just a fool. He’ll never get elected, even to the House or the Senate anymore. There is no fear of him being able to use taxpayer money to achieve his assinine buyback scheme. He is just blowing wind. Ignore him.

Don't get too complacent about it being impossible. They don't need to come to your house. They can mess up your life from a computer terminal in DC.

If they have records, they will just assess you money, and garnish your salary and freeze your bank accounts, until you are either surrender the guns on their list, or you are able to satisfactorily convince them why you don't have them.

Beto simply lies. He incorrectly states the U.S. loses 40,000 a year to gun violence a year, and no other nation comes close. First "gun violence" is an Orwellian propaganda term that conflated suicide, homicide, and accidents. Of the 40,000 only about 14,000 are homicides, and a couple thousand of those are justified homicides. Brazil has more than 40,000 homicides, alone, with guns a year.

Numerous other countries have a higher "gun death" rate than the U.S.
