Judge to Hillary’s IT lackey: Before you take the Fifth, let’s see that immunity deal, bro

If you observe the way people from HillaryWorld operate, you could be forgiven for thinking anyone can invoke the Fifth Amendment any time they just don’t feel like answering a question. That’s certainly the way Bryan Pagliano seems to be playing it. Even though he’s been given immunity from prosecution by the Justice Department, and can cite almost no serious risk of self-incrimination, the guy who set up Hillary’s schlock, homebrew e-mail server still seems to think he can take the Fifth rather than answer questions in a deposition by Judicial Watch - the conservative legal group that’s suing for the release of public records Hillary wants hidden.

Can he?

What the judge did not understand is that he is asking for witness protection.

He doesn’t have immunity in the civil case. He is pleading the 5th in the civil case.

The FBI want him - and we all want him - to plead the 5th in the civil case so that Hillary doesn’t get wind of what he knows for the criminal case.

The whole concept of immunity is to induce someone to testify not take the fifth. He can’t have it both ways.

If he was smart, he'd testify now and get it over with since he's a greater threat pre-testimony than after......

I agree...but Judicial Watch may (depending on the immunity deal) be able to claim that Pagliano’s taking of the 5th constitutes an admission of wrongdoing (in a civil proceeding), and the logical next step would be for them to depose HRC herself. So I assume the judge is just dotting i’s and crossing t’s before this suit goes nuclear.

IIRC, the judge is requiring Judicial Watch to make public the depositions...so we might get to see HRC deny, deny, forget on tape, which would be a treat.

The immunity deal is with the FBI, for a criminal case. It doesn't provide him immunity in a civil case.

Pagliano has a justifiable fear of testifying: if he contradicts what he has told the FBI, or is forced to answer a question the FBI didn't ask, the FBI can prosecute him. It's safer to avoid testimony altogether.

Another possibility: The FBI doesn't want Pagliano to testify. Pagliano would reveal what he told the FBI, and give the rest of the Clinton Crime Syndicate a chance to change their stories.

Is someone allowed to get an immunity deal AND plead the fifth? Wouldn’t the latter nullify the former?

Different case.

He has a grant of immunity in the on-going criminal case to do with emails, but would tend to self-incriminate if he gave testimony in the civil case (to do with FOIA) being brought by Judicial Watch.
