“Yeah, but who is gonna uphold the first amendment???”

The same Court and Congress upholding the 10th Amendment!

The left, enabled by the Supreme Court is beginning a full assault on the Bill of Rights:

1) Freedom of speech - hate speech laws, internet regulation, “fairness” doctrine for broadcast media (i.e. end to conservative talk radio).
2) Freedom of the press - internet regulation, broadcast licensing to intimidate mainstream broadcast media
3) Freedom of religion - hate speech, gay marriage, nonprofit status
4) Right to bear arms - replace Scalia with a liberal and the Court will rule the second amendment applies to citizens serving in the national guard (militia), not the public.
5) Fourth amendment protections against unreasonable search and seizure have been gutted by George Bush’s Patriot Act and the unrestrained snooping of the IRS, NSA, CIA and FBI.
6) Fifth amendment protections have been eviscerated by the IRS, Patriot Act, and regulatory processes which allow property to be seized and sold without due process.
7) Kelo decision allows private property to be seized for private, not public purposes.
8) Right to a speedy trial is long gone. The government routinely drags out litigation against citizens in order to destroy businesses and increase the cost to the citizen of litigation. No business or individual can afford to litigate against today’s government.
9) Civil rights laws effectively allow a person to be put in double jeopardy (tried twice for the same crime).
10) Amendment 10 is effectively meaningless. The Supremes have ruled time and time again its legal precedents, the 14th Amendment, and the Supremacy Clause trump the 10th.

Lawrence Tribe and the other progressive Harvard and Yale Law School proponents of a “living Constitution” have won. There is no need to ever amend the Constitution again. The imperial executive branch and the Supremes will interpret the document for the times.
