NO-KNOCK POLICE RAID ENDS IN BLAZING TRAGEDY

Gun owners and self-defense advocates are lauding a rare victory in which a Texas grand jury has refused to indict a homeowner for shooting and killing a police officer who entered his home unannounced in the middle of the night.

The homeowner, Henry Magee, 28, said he thought the officers who broke through his door were robbers and he acted in self-defense to protect his pregnant girlfriend and two children.

Police were acting on a tip from a criminal informant that led them to believe Magee had more than a dozen marijuana plants, all at least six feet tall, in his rural home in Burleson County. Officers included a line on the warrant that Magee also had “possible illegal guns” stolen from the local sheriff’s office. The local magistrate signed off on the warrant, with deadly consequences.

Before the sun came up on Dec. 19, nine deputies broke down the door to Magee’s mobile home and set off a flash-bang grenade. Magee confronted them, firing away as they barged through the door. One of the deputies, Adam Sowders, fell dead.

When the dust settled, they found two small marijuana plants less than six inches tall and four guns, all legally owned by Magee, three of which were locked in a safe.

That’s not nullification, it’s following the law. Refusing to indict for the marijuana plants would be nullification.

againin my earnest search seems to have failed, as it did not turn up, althougfh others have, today. I even used the “phrase” method as a keyword search....

Check out this “conservative” site that chronicles police abuses and provides legal assistance for those targeted by over zealous prosecutors, law enforcement.

Kinda like the conservative brand ACLU. Most folks have no idea the numbers of wrongful no knock swat raids, police abuses in America today. Militaristic swat raids have soared from a few thousand a decade ago to over 70,000 a year. Boyz with their toyz.

There is utterly no justification for no knock entry if the object is multiple 6 foot boo plants. Do they really fear that the suspect will flush the plants down the toilet before the police can gain entry by knocking at the door? or surrounding the house and calling for the occupant to come out with his hands up?

there was no tragedy. The officers got what every officer going after an innocent Citizen unannounced in his home should receive. No exceptions.

Glad to see you are properly edified. I like to nullify misapplication of words, especially among conservatives. Jury nullification has a very specific meaning that does not apply to this situation.

I fail to see the tragedy, with the exception that the other 8 armed invaders, the magistrate, and the so called criminal informant haven’t been Indicted under the Felony Murder Rule for this persons death. They should all swing.

This is an outgrowth of gun liberty, that police are not so gleeful about smashing down someone’s door in the middle of the night based on an anonymous tip or a revenge “SWATting”.

A realistic view of things is that police should never do a smash invasion, unless the person they are after is armed and dangerous, has already committed violent felonies involving weapons, is holding a hostage, or has themselves made threats to the police.

In Georgia, the police can toss a grenade in a crib. It was ruled proper police work.

A few years ago in Colorado the AG told the police that homeowners would not be prosecuted for shooting no knock intruders. Very few no knock Gestapo raids here now.

Legal pot helps out too.

It's just Ludicrous to toss grenades into a house with children...hell, it's Ludicrous to toss grenades for simple drug possession cases.

Out of hand. Seriously, go out to the Rutherford institute. You'll see swat raids for home schooling, militaristic swat raids on dairy operations and so forth. Just ridiculous.
