NO-KNOCK POLICE RAID ENDS IN BLAZING TRAGEDY

Gun owners and self-defense advocates are lauding a rare victory in which a Texas grand jury has refused to indict a homeowner for shooting and killing a police officer who entered his home unannounced in the middle of the night.

The homeowner, Henry Magee, 28, said he thought the officers who broke through his door were robbers and he acted in self-defense to protect his pregnant girlfriend and two children.

Police were acting on a tip from a criminal informant that led them to believe Magee had more than a dozen marijuana plants, all at least six feet tall, in his rural home in Burleson County. Officers included a line on the warrant that Magee also had “possible illegal guns” stolen from the local sheriff’s office. The local magistrate signed off on the warrant, with deadly consequences.

Before the sun came up on Dec. 19, nine deputies broke down the door to Magee’s mobile home and set off a flash-bang grenade. Magee confronted them, firing away as they barged through the door. One of the deputies, Adam Sowders, fell dead.

When the dust settled, they found two small marijuana plants less than six inches tall and four guns, all legally owned by Magee, three of which were locked in a safe.

Want in my house? 1. Have a warrant, AND 2. Knock nicely. If you have a warrant, I’ll let you in with no trouble whatsoever and will cooperate fully. Knock my door down and come in full assault, well, you’re gonna be facing a barrage of hot lead, period.

Castle doctrine & stand your ground. Plus jury nullification.

Doesn’t matter who it is barging in in the middle of the night, in Texas, you have a right to defend life & property.

I agree, investigate that magistrate!

You mean criminal informants are unreliable? Who knew?.......... A lot of those scumbags would throw their own grandma under the bus to save their own hides. What a tragedy AND a cluster.

It makes no practical sense. They know he’s in there. They know he has to come out. There’s absolutely no reason I can think of not to wait until he does, except cops wanting to play army.

All that for a couple of small pot plants....good grief!

What about the kiddos? So if multiple cops open fire inside a trailer home, would this not place the kids lives in danger?

Over a couple of pot plants? Man oh man, what has this country become?

Magee remains in jail on felony drug charges.

His bond has been lowered from $1 million to $50,000.

For two 6 inch high pot plants?? They are going to get this poor guy no matter what.

I wish someone with clout would start a group called HOMEOWNERS AGAINST NO-KNOCK WARRANTS. Each member has a decal on their front door warning anyone entering without knocking will be shot.

A No-Knock raid over pot plants? Isn't this a bit excessive? Not surprised it ended in tragedy. They really need to re-think the whole No-Knock raid thing.

One of the arguments for no knock raids is to keep drug suspects from flushing the evidence down the toilet while the police are knocking. I would like to know what brand of toilet the cops think can flush a dozen six foot pot plants while a warrant is being peacefully served.

Things like this are why I think I'll vote for Ohio's pending marijuana legalization. I don't smoke pot, never have and think it is a stupid thing to do. But on the other hand cops knocking down doors and tossing around concussive grenades like confetti is a far greater threat to me than a neighbor with a couple plants and a grow light.
