It's bad enough that we traded five terrorists for a deserter; but now they can't even publicly charge him in order to please a president that has shown nothing but contempt for our military from day one. It's beyond shameful the way they protect Obama.

Think about this: Soetoro has illegally "altered" his own Affordable Care Act (sic) law 24 times. He issued a "memo" (not even an Executive Order) that normalized relations with the criminal Cuban Communist regime. He granted amnesty to millions of Illegal Invaders. He illegally funneled Billions of dollars to Muslim terrorists while he simultaneously furloughed 90% of the Defense Department civilians, cutting their salaries by 20%.
Does anyone honestly think that even if the DoD brass stick their necks out and defy Obama's orders to not charge Bergdahl, that Obama will simply issue a "memo" that exonerates him?
And what would Congress do? NOTHING! That is all they have been doing.

If they weren’t going to take him to courts martial, he would have already been discharged since his EAOS was up years ago.
I think this is push back by the military to their Commander in Chief- Barry Barack Hussein Soetoro Soebarkah Ram a Lam a Ding Dong Obama, without sticking their necks out too far, thus avoiding a straight out firing, therefore saving their rank and pensions. Not the bravest of actions, but a seismic shift in the right direction none the less.
Kirby is in a bit of a box. I think I remember a process for releasing charges, and if that process is violated, then it opens the command up to UCI accusations at trial. The defense will claim an effort to taint the jury by releasing command thinking ahead of time. Something like that.
I’m not sure about all this, but somewhere is sticks in the back of my mind that a process must be followed.

One possible option, Bergdahl pleads guilty, received a BCD, reduction in grade, no confinement, possible forfeiture of pay and allowances.
