ADM John Kirby isn’t fooling anyone by his denials that a decision has been made to move forward on preferring charges of “desertion” against Sad Sack SGT Bowe Bergdahl.

The Pentagon spokesman can claim until he’s blue in the face, that such reports – first made by FOX NEWS and NBC, and now confirmed by MilitaryCorruption.com – are “patently false,” but what will he do when his disingenuous remarks come back to bite him?

Probably what any good public affairs officer (and paid liar) would. Suck it up and move on.

What we now know and can tell you is, Eugene Fidell, the sergeant’s capable attorney, has in his possession the charge sheet, seeking prosecution for desertion. He won’t comment or confirm this publicly, but it’s a fact. The Pentagon is digging a deeper and deeper hole for themselves trying to deny what has already taken place.

IMHO, Obama released the 5 Gitmo big shots because he knew ISIL was getting ready for their huge offensive to take over the Syria, Iraq and the rest of the Middle East to establish a Muslim Brotherhood/ al Qaeda dominated Caliphate of the Islamic State and he wanted to spring the five before it started because the American people would never accept their release once the offensive started.

I know Pentagon brass has out up with a lot of crap from presidents for a long time, but you have to wonder when are they ever going to say, "Enough is enough".

Bergdahl will never face the music as long as Barry the Muslim is in power.

Think about this: Soetoro has illegally "altered" his own Affordable Care Act (sic) law 24 times. He issued a "memo" (not even an Executive Order) that normalized relations with the criminal Cuban Communist regime. He granted amnesty to millions of Illegal Invaders. He illegally funneled Billions of dollars to Muslim terrorists while he simultaneously furloughed 90% of the Defense Department civilians, cutting their salaries by 20%.

Does anyone honestly think that even if the DoD brass stick their necks out and defy Obama's orders to not charge Bergdahl, that Obama will simply issue a "memo" that exonerates him?

I think this is push back by the military to their Commander in Chief- Barry Barack Hussein Soetoro Soebarkah Ram a Lam a Ding Dong Obama, without sticking their necks out too far, thus avoiding a straight out firing, therefore saving their rank and pensions. Kirby is in a bit of a box. I think I remember a process for releasing charges, and if that process is violated, then it opens the command up to UCI accusations at trial. The defense will claim an effort to taint the jury by releasing command thinking ahead of time. Something like that.

I’m not sure about all this, but somewhere is sticks in the back of my mind that a process must be followed.

I’ve ping a few experts, so we’ll see if they wade in.

Haven’t seen a lot of details, but if the defense released the charge sheet, it’s tough to call it undue command influence. You are correct, though - there are always the optics to consider.

One possible option, Bergdahl pleads guilty, received a BCD, reduction in grade, no confinement, possible forfeiture of pay and allowances.
