Why? There’s no evidence that he choked Garner and the grand jury has cleared him of breaking the law. Even the paramedics who were suspended are back on the job.
In 2013 there were over 228,000 misdemeanor arrests in NYC. You ain’t calling a boss to all of them. A boss already has to verify every arrest after they happen. They can’t hold your hand during all of them.
The NYPD has a manual that’s about 3,000 pages long. If the cops did anything outside of the guidelines, he’ll be suspended at the very least. If he keeps his job it’ll be kept quiet and he will most likely never be on the street again. Which is no kind of career for a street cop.
And in what percentage of these arrests was a morbily obese large man resisting arrest by merely refusing to comply? Less than .01%? Only one single incident? After NYPD ends up paying a boatload to this man's family I bet they revise their procedures.
ALL crimes are 'capital crimes', by your definition.
When "we", through the actions of our elected legislators, decide to prohibit or mandate some action, we also authorized police officers to arrest and imprison those who disobey the prohibition or mandate. What does "arrest" mean? In practice, it means capture the subject, bind him, and put him in a cage ... and those charged with doing so are authorized to use deadly force, if necessary, to effect such capture.

If you don't want people being killed for selling cigarettes, DON'T PASS A LAW PROHIBITING THE SALE OF CIGARETTES!!!
I’m not sure what your point is. You aren’t going to judge someone’s physical health when you’re locking them up. The NYPD had paid out over $500,000,000 over the last 5 years to settle cases. So I don’t think this case is going to break any new ground.
You should when you are about to use a tactic which you know can kill. The dangers of using a "choke" or "sleeper" hold are well known and I was warned of them 30 years ago when I was taught the tactic. I was taught the manuever was especially dangerous to obese people or anyone who has difficulty in breathing.
But the NYPD has already banned the practice. But it’s not against the law. So he wasn’t indicted, but he will most likely face department charges.

No because he didn’t die from being arrested. He died from the way they arrested him. You don’t apply a potentially lethal hold on someone for selling cigarettes.
You would be better off shooting them if they resist. Shoot them in the kneecap. They’ll quit struggling, especially if you threaten the other knee.

I generally don't take seriously people who talk about shooting extremities. That's Hollywood BS.
BTW, my take on this wretched event is that the deceased is deceased because:
1) NYC is a disgusting nanny-state.
2) The deceased was a belligerent jerk.
3) The deceased was morbidly obese.
Number (1) above is the primary fault ... the people most responsible for his death are the politicians.
If you are close enough to arrest, you just stick the pistol in the back of the knee and blow it off. They’ll get peaceful after that. Beats killing them.
