Justice Department officials today announced that Timothy DeFoggi, former director of the US Department of Health and Human Services (HHS) Cyber Security division was convicted for his role in a child pornography ring. DeFoggi, 56, was convicted of engaging in a child exploitation enterprise, conspiracy to advertise and distribute child pornography, and accessing a computer with intent to view child pornography in connection with his membership in a child pornography website by a federal jury in Nebraska\, according to an official statement by officials with the FBI's Omaha Division.
DeFoggi is the sixth individual associated with the child porn ring to be convicted in an ongoing investigation centering on three websites. According to testimony, former HHS Cyber Security Director Timothy DeFoggi, formerly of Germantown, Maryland, registered as a member of he site in March of 2012. He was still listed as a member and active participant when the FBI took down the site in December of that year. According to testimony, DeFoggi accesses and solicited child pornography from fellow site members and exchanged private messages in which he expressed desires to violently rape and murder young children. Transcripts also indicated he discussed meeting a fellow site member in person to carry out their mutual fantasies to rape and murder underage children.
DeFoggi is scheduled to be sentenced on November 7, 2014. His lawyer, John S Berry Jr. said the case raised many "interesting and complex issues" and he and DeFoggi will discuss whether to move for a new trial. Berry also indicated that Fourth Amendment right's were possibly violated in relation to the searches of his home and personal computer.
He went on to say that, "there was quite a bit of searching by the government, and one of the issues is whether those searches were in fact legal," questioning whether certain obtained evidence was admissible.
If convicted DeFoggi could face 20 years to life in prison on the charge of engaging in a child exploitation enterprise, the most serious of the charges. Thats actually a very good point RightOnTheBorder. I read through the DOJ statement and youre absolutely right. They list him as the former “acting director” but at no point do they say if and when he was terminated. Im gonna follow up on that my friend. Good call.
Another example of the waste, fraud and abuse of government employees...at HHS this time. And as Cyber-Security chief no less...pretty telling of the lack of qualifications of this latest creep. makes one wonder how many viruses snuck in to any number of government systems simply by accessing a site like that, let alone the profoundly disgusting and criminal exploitation of the most vulnerable. Security clearances mean a whole lot less than they used to anymore. I hope he goes into the general population..

Indeed, well said. And completely concur on the latter point, although (once again, the doings of the left) from what I understand in fed prison and many states, they no longer put pedophiles in gen pop, as it creates an “undo danger” to them....I would not call it an “undo danger” I would call it justice.
