One of the reasons I never even tried to get into IBM was that even after they got rid of the jacket and tie rule the jacket and tie culture has remained and I refuse to put a noose around my neck. If a company has a dress code/ culture I don’t want to wear I ain’t going, if my company changes to something I don’t want I’m leaving.

So no, my “sanctimonious” comment remains, when the uniform changed to something she didn’t like she was free to go, just like me.

Maybe because it’s sexist? The men weren’t forced to dress scantily.

The place where this woman worked is a sports bar.. a place where a guy can hang out with his friends. A guy does not want a male server unless he is gay. There are three sports bars in my area and no male servers...so who now is sexist?

No, clothes I won’t wear are clothes I won’t wear, the specifics of the clothing are besides the point. I was giving you a real world example to back up my statement. If my company went to mandatory thongs I’d leave, but that’s unlikely to happen in the software business. But what HAS existed in the software business is mandatory ties, which I also won’t wear, and I have specifically avoided working in those environments.

It’s really not that tough a concept. Companies are free to spawn dress codes and uniforms, and employees are free to say “I ain’t wearing that” and leave. The specifics of what they won’t were don’t matter in the discussion, the concepts remain identical with thongs, ties or sweater vests.

Nobody is a dog, it’s just simple reality of the industry. The vast majority of the table waiting staff of the country is female anyway, when the business caters to a primarily male customer base like sports bars do that percentage goes up. It’s how the food service and bar industry works. The one type of restaurant where you’re likely to find male servers is high end, the bigger your bill the more guys are on the floor.

I am not a lawyer, nor do I play one on TV, but this doesn’t smell good from the perspective of the business owners in my book.

Frankly someone wants to run a skin place that’s their perogative, but frankly I just don’t get those places, let alone when I see someone with their family in there.

When I was in my late 20s/early 30s I used to ride a motorcycle and I rode mostly with guys who were a decade or so older than me, and whenever we would go out riding they would inverably want to stop at a hooters or some thing. I never got it, I at that age found the gals jail bait for ME, let alone the guys a decade or more older than me and was frankly embarassed by the behavior the fellow riders would show.. now don’t get me wrong, I’m as red blooded a male as you can find, and love women.. Just never felt right.. It was during that time I came to realize that this was literally these guys strip club... their wives would have killed them had they gone to a legitimate one, so they came here.

I have been to strip clubs, and am not a prude by any means, but to pay 3 times the going rate for some mediocre food just because a young gal in a short skirt and push up bra served it to me? Sorry, don’t think so. I know the girls take those jobs voluntarily, and I’m sure they play the old guys like fiddles for big tips.. but I just never got it. Just never felt right. A gal wants to wear that sort of thing for me, I’m all over it... but she’s wearing it as part of her job... beyond the initial, yep i’d hit it reaction, it is kind of a turn off for me.

Don’t mind cleavage, or tight form fitting clothing, but in public, prefer it to be a bit more classy than trampy. In private... all bets are off :)

Love a gal who looks good in a skimpy outfit, but want one with enough self respect and decorum to wear it for me, not for the old letches like my riding buddies for a few more bucks.

But I digress...

Wrong. I worked for a company that at the time of my hiring didn’t require neckties. They changed that policy two years later.

Under you argument I could sue them. I don’t think so.

You mean like her body as her private property you feel because osmeone pays you they can epxloit? Maybe she should be obligated to perform oral sex on patrons as part of her job, I mean, she is getting paid isn’t she?

The owners can decide what they want to do when it comes to their business.

Your suggestions almost sound like a dictate.

We have a restaurant around my city call “Twin Peaks” that makes Hooters look like a G rated movie. They have a waiting list for servers. Good food, cheap cold beer and a view!

Good business model.

All of you people who say she is wrong to sue are wrong. She started employment there with the expectation of being able to wear the pants and shirts as the uniform. This is an implied contract. The company has no right to change the contract without her approval. The way for the company to handle it would have been to require all new hires to wear the new uniform and the old hires could go either way as they saw fit. Eventually they would have all the girls wearing the new uniforms.

To sum it up. She had a contract, they violated it without her agreement. She will win in court, especially in view of the way they cut her hours vindictively and then dismissed her without cause.
